BOCKMANN, ERIC T. <br />BOCKMANN, AND KELLI D. ERIKSEN, Co -trustees of the K. Diane Bockmann Revocable Trust dated <br />December 27, 2000; and JAY D. BOCKMANN, ERIC T. BOCKMANN, AND KELLI D. ERIKSEN, Co - <br />trustees of the Darryl D. Bockmann Revocable Trust dated December 27, 2000, and their successors or <br />assigns, collectively "Grantor", for and in consideration of the amount set forth in this easement, does hereby <br />grant unto SOUTHERN PUBLIC POWER DISTRICT, a public corporation whose post office address is <br />Grand Island, Nebraska, and to its successors or assigns, collectively "Grantee"; the right to enter upon the <br />lands of the Grantor, situated in the County of HALL, State of Nebraska and more particularly described as <br />follows: <br />SOUTHERN PUBLIC POWER DISTRICT <br />ELECTRIC UTILITY RIGHT-OF-WAY EASEMENT <br />Legal description on attached Exhibit "A" incorporated herein by reference. <br />Grantor hereby grants the right to construct, operate, repair, maintain, relocate, and replace electric utility <br />line facilities, including existing electric utility line facilities already in place, together with the necessary <br />appurtenances, in, over, and upon the above-described easement, along with rights of ingress and egress. <br />And to cut and trim trees and shrubbery to the extent necessary to keep them clear of said electric line <br />facilities, and to cut down from time to time all dead, weak, leaning or dangerous trees that are tall enough to <br />strike the electric line facilities in falling. <br />The Grantor shall maintain all other rights of possession, including rights of ingress and egress over the <br />easement properties described above. <br />The Grantor shall not construct any buildings, structures, signs, or light poles, or plant any trees or <br />shrubbery, over or on said easement area without the prior express written consent of the Grantee. <br />Compensation for this easement shall be in the amount of $25.00 per pole and/or anchor. Payment will be <br />made after construction plans are final and number of poles and/or anchors can be determined. Grantor will <br />be reimbursed for all crop damage caused during construction of the line. <br />The undersigned covenants that he is the owner of the above-described lands and that the said lands are free <br />and clear of encumbrances and liens of whatsoever character except covenants, conditions, easements, and <br />restrictions of record, including those held by the following persons: <br />City of Grand Island – Easement for Sanitary Sewer Line <br />It is further understood that, whenever necessary, words used in this instrument in the singular shall be <br />construed to read in the plural and that words used in the masculine gender shall be construed to read in the <br />feminine. <br />Signature page(s) attached. <br />
