<br />That a Deed of Trust was made and entered into on or about July 8, 2011, by and between
<br />Darren Rowe and Rhonda Rowe, Husband and Wife, as Trustor, and Vicki Kissler and Kirk
<br />Douglas Kissler, Sister and Brother, as Beneficiary, wherein Kevin A. Brostrom, Attorney at
<br />Law, is named Trustee. This Deed of Trust was recorded July 11, 2011, in the Records of the
<br />Register of Deeds of Hall County, Nebraska as Instrument No. 0201105101. On May 1, 2023, a
<br />Substitution of Trustee was recorded in the Records of the Register of Deeds of Hall County,
<br />Nebraska as Instrument No. 202302293, naming Zachary Butz, Attorney at Law, as Trustee,
<br />hereinafter referred to as GRANTOR.
<br />The GRANTOR in consideration of Four Hundred Thirty Thousand Dollars
<br />($430,000.00) and other valuable consideration received from Tommy Ummel, Sr., hereinafter
<br />GRANTEE, does hereby grant, bargain, sell, convey and confirm unto GRANTEE the following
<br />described real property in Hall County, Nebraska:
<br />Lot One (1), Alderson Second Subdivision, f/k/a Lots One (1) and Two (2),
<br />Alderson Subdivision, City of Grand Island, Hall County, Nebraska, as shown in
<br />Document No. 201107866
<br />To have and to hold the above-described premises together with all tenements,
<br />hereditaments and appurtenances thereto belonging unto the GRANTEE, and to the
<br />GRANTEE'S successors and assigns forever.
<br />GRANTOR does hereby covenant with the GRANTEE and with the GRANTEE'S
<br />successors and assigns:
<br />1. Breach and default were made under the terms of the Deed of Trust in the
<br />particular set forth in the notice of default hereinafter referred to, which default continued until
<br />the time of sale.
<br />2. There was filed for record on July 11, 2023, as Instrument No. 202303493 an
<br />Amended Notice of Default in the Office of the Register of Deeds of Hall County, Nebraska, of
<br />the election to sell the property to satisfy the obligations secured thereby and thereafter notice of
<br />the filing of the Amended Notice of Default was sent in the statutory manner to all persons
<br />entitled to a notice thereof.
<br />3. That thereafter Notice of Sale was properly made stating that Trustee would sell
<br />at public auction to the highest bidder the property hereinbefore described, fixing the time and
<br />place of the sale as December 11, 2023, at 10:00 o'clock A.M. at the lower lobby of the Hall
<br />County Courthouse, Hall County, Nebraska and caused copies of said notice to be published
<br />once a week for five consecutive weeks in the Grand Island Independent, a legal newspaper
<br />printed, published and of general circulation in the County of Hall, Nebraska. The first date of
<br />publication was October 31, 2023, and the last day of publication was November 28, 2023.
