<br />The undersigned, THE DIOCESE OF GRAND ISLAND, a Corporation (Grantor), in S
<br />consideration of ONE THOUSAND ONE HUNDRED SEVENTY -SEVEN DOLLARS AND O
<br />FORTY CENTS AND OTHER VALUABLE CONSIDERATION ($1,177.40), received from
<br />the CITY OF GRAND ISLAND, NEBRASKA, a Municipal Corporation (Grantee), receipt of
<br />which is hereby acknowledged, does hereby grant, bargain, sell and convey to the CITY OF
<br />GRAND ISLAND, NEBRASKA, a Municipal Corporation (Grantee), a permanent and perpetual
<br />easement and right -of -way to construct, operate, maintain, extend, replace, repair, and remove
<br />sidewalks and hike/bike paths along the south side of the property located on the following
<br />described tract of real estate:
<br />A tract of real estate located in Lot Eleven (11), Sussex Place Subdivision, in the
<br />City of Grand Island, Hall County, Nebraska, more particularly described as
<br />follows:
<br />Beginning at a point on the west line of Lot Eleven (11), Sussex Place
<br />,y bdivision, suid P-int being thirty -fi:'e feet (25') north of the southwest comer
<br />of said Lot Eleven (11), thence continuing north on the west line of said Lot
<br />Eleven (11) for a distance of fourteen feet (14'), thence southeasterly on a line to
<br />a point on the east line of Lot Eleven (11), said point being forty feet (40') north
<br />of the southeast corner of Lot Eleven (11), thence south on the east line of said
<br />Lot Eleven (11), for a distance of fourteen feet (14'), thence northwesterly on a
<br />line to the point of beginning.
<br />The Grantee's rights shall include all rights necessary for the full and complete use, occupation
<br />and enjoyment of the easement herein granted, including the right to excavate and refill ditches,
<br />to remove trees, bushes, hedges, undergrowth, and other obstructions interfering with the
<br />location, construction, inspection, repair, replacement, removal, and maintenance of such
<br />sidewalks and hike/bike paths; provided, if such construction or maintenance requires the
<br />removal of hard - surfacing or grassed lawns, the Grantee or its contractor agrees to restore the
<br />surface of the easement area as soon as possible to its condition prior to said construction or
<br />maintenance work.
