202308925 FSA -2300-7 NE (10-16-23) Page 2 of 2 It is specifically understood and agreed this instrument shall not be construed as a subordination of the Prior Indebtedness, defined to be a Note or Debt Instrument dated (13)11/08/2023 whose principal balance does not exceed the Maximum Lien Amount(s) of 04): $ 300 000.00 and including extensions, renewals or modifications thereof. The Lienholder subordinates any and all future lending secured by the above-described security instruments including any principal in excess of the Maximum Lien Amount (except for Permitted Advances); future advances except Permitted Advances (defined to mean those made for taxes, insurance or payment on other prior Liens, or those for which the Lienholder obtains prior written consent of the Government); and any additional lending (regardless of whether now existing or made in the future), however defined, including other notes, lending, credit, advances, and extensions of new principal (including through a modification), secured under a cross -collateralization, future advance, or similar clause. This subordination covers: (1) the amount actually loaned by the Government to the Borrower (principal and accrued interest) for the foregoing purposes, (2) future advances for taxes, insurance, payment of prior liens, and protection of the security, and (3) the amount actually advanced for foreclosure costs made by the Government.
