Declaration. Each owner shall take all necessary action to keep the limited common elements free
and clear from unsightly accumulations of weeds, trash and litter.
A unit owner may make any improvements or alterations to the unit that do not impair the
structural integrity or mechanical systems or lessen the support of any portion of the condominium.
A unit owner, other than the Declarant, may not change the appearance of the common elements
or the exterior appearance of a unit or any other portion of the condominium, without the written
approval of the association.
12. Use of Units. No unit shall be used other than for commercial business, educational,
health care, daycare, fitness facility or office purposes. No immoral, improper, offensive, or
unlawful use shall be made of any part of the condominium. All valid laws, zoning ordinances,
and regulations of all governmental bodies having jurisdiction over the condominium shall be
observed. Any violation of such laws, zoning ordinances or regulations shall be a violation of this
Declaration.
13. Nuisance. No noxious or offensive activity shall be permitted within any unit, or
anything which is an annoyance or nuisance or which endangers the health or unreasonably
disturbs the quiet of the occupants of adjoining units.
14. Easements for Support. Each unit and common element shall have an easement for
lateral and subjacent support from every other unit and common element.
15. Utility Easement. There is hereby created an easement upon, across, over and under
the common elements, for reasonable ingress, egress, installation, replacing, repairing or
maintaining of all utilities, including but not limited to water, sewer, telephone, cable television,
natural gas and electricity. By virtue of this easement, it shall be expressly permissible for the
providing utility company to erect and maintain the necessary equipment on the common elements.
Notwithstanding anything to the contrary contained in this section, no sewers, electrical lines,
water lines, or other utility or service lines may be installed or relocated on the common elements
except as initially designed, approved and constructed by the Declarant or as approved by the
association. This easement shall in no way affect any other recorded easements on the common
elements.
16. Easements for Encroachments. Each unit and the common elements shall be subject
to an easement for encroachments, including without limitation encroachments of walls, ceilings,
ledges, floors, and roofs created by construction, settling and overhangs as originally designed and
constructed or as exists as discrepancies between the attached Exhibit "A" and the actual
construction. If any portion of the common elements shall actually encroach upon any unit, or if
any unit shall actually encroach upon any portion of the common elements, or if any unit shall
actually encroach upon another unit, as the common elements and the units are shown on the
attached Exhibit "A", a valid easement for any of the said encroachments and for the maintenance
thereof, so long as they stand, shall and does exist. In the event that any units or structure is
repaired or altered, the owners of the units agree that similar encroachments shall be permitted and
that a valid easement for such encroachment and for the maintenance thereof shall exist. The
owner and any other parties acquiring an interest in the condominium shall, by accepting a deed
or otherwise becoming the owner of a unit, agree to the existence of such easements.
17. Easement for Ingress and Egress. There is hereby created an easement for ingress and
egress for pedestrian traffic over, through and across sidewalks, paths, walks and lanes that from
time to time may exist upon the common elements. There is also created an easement for ingress
and egress for pedestrian and vehicular traffic over, through and across such driveways and parking
areas attributable to the common elements as from time to time may be paved and intended for
such purposes; provided, however, that such easements shall not extend to any limited common
elements. Such easements shall run in favor of and be for the benefit of the owners and occupants
of the units and their guests, families, tenants and invitees.
18. Signs. No signs (including "For Sale" or "For Rent" signs) shall be permitted on the
exterior of any unit or building or any other portion of the condominium without the written
approval of the association. However, the Declarant reserves the right to maintain on the common
elements such advertising signs as may comply with applicable governmental regulations.
The reservation of rights in this paragraph shall be applicable to any real estate added to
the condominium. The right reserved under this paragraph shall terminate at such time as
Declarant has conveyed all units to unit owners other than the Declarant.
