Brasee, Esq., 409 S. 17th Street, Suite 500, Omaha, NE 68102] <br />DEED OF TRUST <br />THIS DEED OF TRUST is made as of October 27, 2023, by and by and among Platte River <br />Whooping Crane Maintenance Trust, Inc., a Nebraska nonprofit corporation (the "Trustor"), whose <br />mailing address is 6611 Whooping Crane Drive, Wood River, Nebraska 68883; Old Republic National <br />Title Insurance Company (the "Trustee"), whose mailing address is 14323 South Outer 40 Road, Suite <br />200-S, Chesterfield, MO 63017; and Platte River Mallard Haven, Inc., a Nebraska corporation (the <br />"Beneficiary"), whose mailing address is 3725 E 82°d Street, Hastings, Nebraska 68901. <br />WITNESSETH; <br />WHEREAS, Trustor has promised to pay the full and prompt payment of the sums due under a <br />certain promissory note made to Beneficiary in the original principal sum of $335,000 of even date <br />herewith (the "Note"). <br />NOW THEREFORE, for the of securing: <br />(a) payment and performance under the Note, together with interest thereon, late charges, <br />prepayment penalties, premiums, or fees, default fees, any future advances, and all extensions, <br />modifications, substitutions and renewals thereof; <br />(b) payment of all other sums, fees or charges, together with interest thereon, advanced to protect the <br />security of this Deed of Trust and the performance of the covenants and agreements of Trustor, whether <br />or not set forth herein; and <br />(c) performance, discharge of and compliance with every term, covenant, obligation and agreement <br />of Trustor contained herein or incorporated by reference or any other security instrument at any time <br />given to secure any obligation of Trustor to Beneficiary, <br />all of which is hereinafter collectively called the "Indebtedness", Trustor irrevocably grants and <br />transfers a first lien to Trustee, in trust, WITH POWER OF SALE, the real property legally described on <br />Exhibit A attached hereto and incorporated by reference, together with (i) all buildings, structures, <br />additions, enlargements, modifications, repairs, replacements, and improvements now or hereafter located <br />thereon, (ii) all equipment, machinery and fixtures (including, without limitation, all lighting, heating, <br />ventilating, cooling, air conditioning, sprinkling and plumbing fixtures, water and power systems, <br />3076407v3 1 <br />CLICe(= <br />
