202305648 <br />PRIVATE AGREEMENT AMONG SUCCESSOR <br />TO DECEDENT <br />COME NOW, Daniel M. Fredrick, the duly appointed and currently acting Personal <br />Representative of the Estate of Richard M. Fredrick ("the estate"), and Daniel Fredrick, <br />("Daniel"), Larry Fredrick ("Larry") and Timothy Fredrick ("Timothy"), all three of whom are <br />the sole issue of Richard Fredrick, and sole beneficiaries under his Will. <br />WITNESSETH <br />WHEREAS, pursuant to the Last Will and Testament of Richard Fredrick, his entire <br />estate passes in equal shares to Daniel, Larry and Richard, and, <br />WHEREAS, one of the tracts of land which is an asset of the estate was owned solely in <br />the name of the Decedent, Richard Fredrick, is the following described real estate, to wit: <br />An undivided one-half interest in: <br />A tract of land comprising a part of the Southwest Quarter of the Southwest Quarter <br />(SW1/4SW1/4) of Section Eleven (11), Township Eleven (11) North, Range Ten (10), West of <br />the 6th P.M. more particularly described as follows: Beginning at a point on the South line of said <br />Section Eleven (11), said point being Three Hundred Sixty -Three (363.0) feet West of the <br />Southeast corner of said Southwest Quarter of the Southwest Quarter (SW1/4SW1/4); thence <br />continuing Westerly along and upon the South line of said Section Eleven (11), a distance of <br />Seventy -Two and Six -Tenths (72.6) feet; thence Northerly parallel to the East line of said <br />Southwest Quarter of the Southwest Quarter (SW1/4SW1/4), a distance of Three Hundred <br />(300.00) feet; thence Easterly parallel to the South line of said Section Eleven (11), a distance of <br />Seventy -Two and Six -Tenths (72.6) feet; thence Southerly parallel to the East line of said <br />Southwest Quarter of the Southwest Quarter (SW1/4SW1/4) a distance of Three Hundred (300.0) <br />feet, to the place of beginning and containing 0.500 acres, more or less, of which 0.055 acres, <br />more or less, are presently occupied by County Road Right -of -Way, in Hall County, Nebraska, <br />also known as Lot Four (4), Bockman 1st Subdivision, Hall County, Nebraska, and <br />WHEREAS, the other undivided one-half interest in this property is owned by Daniel, <br />because the Decedent and Daniel Fredrick acquired title to the property as tenants in common, <br />pursuant to a Warranty Deed filed of record with the Register of Deeds of Hall County, Nebraska <br />as Document No. 85-001284; <br />WHEREAS, the parties hereto desire that it is in the best interests of the beneficiaries that <br />the one-half interest in the real estate owned by Richard Fredrick be conveyed to Daniel, as said <br />property constitutes his residence; <br />NOW, THEREFORE, in consideration of the foregoing the estate, and all of the <br />successors to the Decedent agree that the undivided one-half interest in Daniel Fredrick's home, <br />which is an asset of the Estate of Richard Fredrick, be conveyed to Daniel Fredrick. <br />
