202305575 <br />ORDINANCE NO. 4911 <br />An ordinance directing and authorizing the conveyance of part of <br />Custer Avenue vacated by Ordinance No. 4905 to Joseph F. Liess and <br />Loraine A. Liess; providing for the giving of notice of such conveyance <br />and the terms thereof; providing for the right to file a remonstrance <br />against such conveyance; and providing the effective date hereof. <br />BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, <br />NEBRASKA: <br />SECTION 1. The conveyance to Joseph F. Liess and Loraine A. Liess, <br />as joint tenants with right of surviorship and not as tenants in common, <br />of a part of Custer Avenue vacated by Ordinance No. 4905, which tract <br />of land lying in the Southwest Quarter of the Northeast Quarter (SWµNEµ) <br />of Section Seventeen (17), Township Eleven (11) North, Range Nine (9) <br />West of the 6th P.M., Hall County, Nebraska, more particularly described <br />as follows: <br />Beginning at a point on the west line of said Southwest <br />Quarter of the Northeast Quarter (SW4NEµ) and its junction with <br />the east prolongation of the south line of the north fourteen <br />(14) feet of Lot Two (2), Block Sixteen (16) in West View, an <br />Addition to the City of Grand Island, Nebraska; thence running <br />east on the east prolongation of the south line of the north fourteen <br />(14) feet of Lot Two (2), Block Sixteen (16) in West View, an <br />Addition to the City of Grand Island, Nebraska, for a distance of <br />thirty-two and four -hundredths (32.04) feet; thence deflecting to <br />the right and running southeasterly on a curved line, concaved <br />easterly for a distance of thirty-six and sixty-eight hundredths <br />(36.68) feet, said curved line being a portion of a curve commencing <br />at the northeast corner of said Block Sixteen (16), which corner <br />is also the point of tangency for a curve having .a radius of two <br />hundred seventy-eight and eighty-four hundredths (278.84) feet; <br />thence running south on a line parallel to and fifty-seven and <br />thirty-eight hundredths (57.38) feet east from the east line of <br />said Southwest Quarter of the Northeast Quarter (SW-NE4) for a <br />distance of thirty-six and sixty hundredths (36.60) feet; thence <br />running west on a line for a distance of fifty-seven and thirty- <br />eight hundredths (57.38) feet to a point on the west line of said <br />Southwest Quarter of the Northeast Quarter (SW4NE4), said point <br />being sixty-two and twelve hundredths (62.12) feet south from the <br />east prolongation of the south line of the north fourteen (14) <br />feet of Lot Two (2), in said Block Sixteen (16); thence running <br />north on the west line of said Southwest Quarter of the Northeast <br />Quarter (SW4NE4) to the point of beginning, and containing 3,453 <br />square feet, more or less, <br />is hereby authorized and directed; provided and conditioned, that the City <br />of Grand Island, Nebraska, reserves for the public the east sixteen (16) <br />feet of the west thirty-four (34) feet of the aforedescribed tract of land <br />for a public utility easement to construct, operate, maintain, extend, <br />repair, replace, and remove public utilities, including but not limited <br />to sanitary sewer mains, water mains, underground electric distribution <br />1 <br />
