202504180 <br />Grantee shall also have the right to mark the location of the above-described strip by suitable <br />markers set in the ground or on the towers, but the markers when set in the ground shall be placed in <br />fences or location that will not interfere with any reasonable use Grantor shall make of such strip. <br />Grantee shall repair any damage it may do to Grantor's private roads or lanes on the above-described <br />property, and shall indemnify Grantor from and against any and all loss and damage that Grantee or <br />Grantee' s employees, agents or subcontractors shall cause to crops based upon market value at the <br />end of the crop year as calculated by the average production from the field in question. <br />If the easement area is abandoned by the Grantee, the Easement shall terminate and any interest <br />in the easement area shall revert back to the Grantor in its entirety. <br />In addition to and not in limitation of the foregoing, Grantee shall indemnify, defend, and hold <br />Grantor (its successors and assigns) harmless from and against any and all claims, damages, fees <br />or expenses which are in any way relating to or arising out of (i) Grantee's negligent acts or <br />omissions relating to the easement area or any access thereto, (ii) Grantee's failure to properly <br />maintain the easement area, or (iii) Grantor' s breach of its obligations under this instrument. <br />«« SIGNATURES ON NEXT PAGE »» <br />Page 2 of 3 <br />
