Recitals: a. Legacy ("Lessee") is the owner of a billboard structure (the `Billboard") located on land owned by EBMT Properties, LLC (the "Owner") described as follows: A parcel of land situated in the Southeast Quarter of the Northeast Quarter (SE 1/4 NE V4) of Section Fifteen (15), Township Eleven (11) North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska, bounded and described as follows: Commencing at the east quarter corner of said Section 15; thence along the east line of said Section N 00'01'13" E a distance of 66.0 feet; thence parallel with and 66 feet northerly, measured at right angles, from the east -west centerline of said Section 15, N 8"39' W, a distance of 27.0 feet to the True Point of Beginning, thence continuing parallel with said east -west centerline N 89'39' W, a distance of 646.0 feet, more or less; thence N 00'11'36' W, a distance of 675.02 feet; thence S 89'39' E, a distance of 648.04 feet, more or less, to a point that is 27.0 feet westerly, measured at right angles, from said east line of Section 15; thence parallel with said east line S 00'01'13" E, a distance of 675.0 feet to the True Point of Beginning. b. On June 20, 2003, Waitt Outdoor, LLC entered into a lease (the "Lease") with James Thomas and Susan D Pirnie for the construction and maintenance of the Billboard. Legacy Outdoor Advertising, LLC is the successor owner of this billboard to Waitt Outdoor, LLC. EBMT Properties, LLC are the successor owners of the property from James and Susan Pirnie.
