Number: 2311954 <br />Property Address: 1411-1415 W LOUISE ST, GRAND ISLAND, NEBRASKA 68801 <br />I, the undersigned Borrower, acknowledge that the matters referenced in the following paragraphs are to the best <br />of my knowledge and belief, and nothing in this Agreement is to be construed as a waiver of any claims, damages, <br />causes of action, or rights under any warranty, express or implied, against any party other than <br />FAIRWAY INDEPENDENT MORTGAGE CORPORATION <br />its successors and/or assigns ("Lender"). <br />Property Acceptance Agreement <br />Purchase Only: I understand that the Property and all of its improvements, fixtures, appliances and other parts are <br />in good and satisfactory working order and in the condition contracted for. The terms of the contract between the <br />seller and me have been fully carried out. <br />Existing Properties Only: I am familiar with the Property and have accepted the condition thereof. Any required <br />repairs and inspections have been completed and met to my satisfaction. <br />New Construction Only: I find that the improvements erected on the Property have been completed substantially in <br />accordance with the plans and specifications and to my satisfaction. The terms of the contract/written agreement <br />between the contractor and me have been fully carried out. <br />Title Commitment Acceptance Agreement (if applicable) <br />I certify that <br />GRAND ISLAND ABSTRACT AND TITLE COMPANY <br />("Settlement Agent") has provided me with a copy of the Title Insurance Commitment, with each recorded <br />exception, including but not limited to any liens, restrictions, easements, leases and mineral rights affecting the <br />Property. I have reviewed and consent to all of the exceptions to title which would appear in the Owner's and <br />Mortgagee's Title Insurance Policies. <br />Survey Acceptance Agreement (if applicable) <br />If required by the Lender or Settlement Agent, I certify that I have received, reviewed and approved a copy of the <br />survey of the Property, which is incorporated herein by reference. I am aware of any indicated easements, <br />encroachments, protrusions, access, dimensions, boundary lines, access or other conditions shown on the survey. <br />Survey Waiver (if applicable) <br />If a survey has not been required by the Lender or Settlement Agent, I acknowledge that this is my notice that it <br />may be in my best interest to obtain a survey. I understand that I have the option to have the Property surveyed at <br />my own cost and expense. <br />Hold Harmless <br />I understand that Lender assumes no responsibility for the Property or its condition. Lender has made no promises <br />or representations to me about the Property. I acknowledge that the determination of the acceptability of the <br />Property is my responsibility. In consideration of the Lender making me a loan, I hereby hold harmless and <br />indemnify Lender from any claims, costs, damages, liability, causes of action and expenses which may arise <br />resulting from the condition of the Property, any specific conditions (if any listed below), any matters indicated or <br />that may have been revealed on a survey, or any exceptions stated in the title insurance commitment and policies <br />(as applicable) or any loss or damage thereto.
