20001/180 <br />to be made by American Family. The sole signature of American Family shall be sufficient for <br />the exercise of any rights under this Agreement. <br />11. All terms used in this Agreement which appear in boldface type and are <br />not defined herein, shall have the meaning ascribed to such term or terms in the Trust Deed <br />granted by Landlord to American Family. <br />12. Landlord acknowledges for itself that: (a) if American Family notifies <br />Tenant of an Event of Default under the Trust Deed, Tenant shall pay all rent and all other <br />sums due under the Lease directly to American Family or as otherwise required pursuant to <br />American Family's notice and, upon such payment, any and all claims for such rent or other <br />sums by Landlord against Tenant are hereby waived and released; and (b) Landlord shall not <br />agree to any amendment or modification of the Lease without American Family's prior written <br />consent, which consent may be given or withheld in American Family's absolute discretion. <br />13. If there are any conflicting provisions of the Trust Deed and Lease which <br />govern the application of Insurance Proceeds or condemnation proceeds, the provisions of the <br />Trust Deed shall control. <br />14. Tenant represents, warrants and covenants with American Family that it <br />will at all times comply with the environmental undertakings contained in the Lease. Tenant <br />agrees not to allow the installation of any type of storage tank containing any Hazardous <br />Substance on, above or below the Premises. <br />15. This Agreement shall be governed by and construed in accordance with the <br />laws of the State of Nebraska applicable to contracts made and performed in such state. <br />16.
