20001 1130 <br />redemption pursuant to Neb. Rev. Stat. §§ 25 -2148, 25 -2149, 25 -1530, or other applicable law, <br />provided however, that said waiver shall in no case operate to cause a waiver of American <br />Family's right to recover a deficiency judgment. <br />SECTION 6.6 RECEIVER. Upon the occurrence of an Event of Default, <br />American Family shall be entitled as a matter of right, without further notice and without giving <br />bond, and without regard to the solvency or insolvency of Borrower, or waste of the Premises <br />or adequacy of the security of the Premises, to apply for the appointment of a receiver under any <br />applicable statute or law, or in equity, including, without limitation, Neb. Rev. Stat. §§ 25 -1081 <br />et seq. Such receiver shall have all the rights, powers, and remedies as provided by applicable <br />statute or law, including, without limitation, the rights pursuant to Neb. Rev. Stat. §§ 25 -1081 <br />et seq. Such receiver shall collect the rents and all other income of any kind, manage the <br />Premises so to prevent waste, execute leases within or beyond the period of receivership, pay all <br />expenses for normal maintenance of the Premises and perform the terms of the Loan Documents <br />and apply the rents, issues and profits to the costs and expenses of the receivership, including <br />reasonable attorneys' and paralegal's fees, to the repayment of the Indebtedness and to the <br />operation, maintenance, upkeep and repair of the Premises, including payment of Impositions <br />and Insurance Premiums. Borrower hereby irrevocably and unequivocally consents to such <br />appointment. <br />SECTION 6.7 RIGHTS UNDER UNIFORM COMMERCIAL CODE. <br />In addition to the rights available to the beneficiary of a trust deed or to a mortgagee of real <br />property, American Family shall also have all the rights, remedies and recourse available to a <br />secured party under the Code including the right to proceed under the provisions of the Code <br />governing default as to any Collateral. <br />SECTION 6.8 RIGHT TO DISCONTINUE PROCEEDINGS. In the <br />event American Family shall have proceeded to invoke any right, remedy or recourse permitted <br />under this Trust Deed or any other Loan Document and shall thereafter elect to discontinue or <br />abandon the same for any reason, American Family shall have the unqualified right to do so and <br />in such event Borrower and American Family shall be restored to their former positions with <br />respect to the Indebtedness. This Trust Deed, the other Loan Documents, the Premises and all <br />rights, remedies and recourse of American Family shall continue as if the same had not been <br />invoked. <br />SECTION 6.9 NEBRASKA LAW REQUIREMENTS. Nothing in this <br />Article 6 dealing with power of sale, foreclosure procedures or specifying particular actions to be <br />taken by Beneficiary or by Trustee or any similar officer shall be deemed to contradict or add <br />to the requirements and procedures now or hereafter specified by Nebraska law, and any such <br />inconsistency shall be resolved in favor of Nebraska law applicable at the time of foreclosure. <br />
