J. Cunningham, Jr., the duly appointed and currently <br />acting Personal Representative of the Estate of Raymond C. Schmidt, <br />deceased, acting by virtue of Letters of Personal Representative <br />issued by the Hall County Court in Case No. PR01 -110, hereinafter <br />"Grantor" and Roger W. Schmidt, hereinafter "Grantee ". <br />W I T N E S S E T H <br />That for and in consideration of the sum of One Hundred <br />Dollars ($100.00), and other considerations hereinafter set out, <br />the parties agree: <br />1. The Grantor gives and grants to the Grantee the right to <br />construct and maintain an underground electrical transmission line <br />under and through the property owned by Grantor duly described as: <br />The Northwest Quarter (NW1 /4) of Section Fourteen <br />(14), Township Nine (9) North, Range Twelve (12), <br />West of the 6th P.M., Hall County, Nebraska. <br />The Grantor specifically grants a right of way easement <br />to Grantee to bury an electrical transmission line along the east <br />side of the Northwest Quarter (NWl /4) of 14 -9 -12, more specifically <br />as follows: <br />Commencing at the northeast corner of the Northwest <br />Quarter (NW1 /4) of 14 -9 -12, thence directly south <br />along the east side of said Northwest Quarter <br />(NW1 /4) for a distance of 200', thence westerly a <br />distance of 16', thence northerly a distance of <br />200', thence easterly 16' to the point of <br />beginning. <br />In consideration of said right, the Grantee agrees to lay <br />said electrical transmission line at sufficient depth to not <br />interfere with the Grantor's use and enjoyment of said property, <br />and further agrees to pay to Grantor any damages which may result <br />to his property by reason of the construction, maintaining, <br />repairing, and operation of said subsurface electrical transmission <br />line. <br />TO HAVE AND TO HOLD the easement and right hereby granted unto <br />the Grantee, his heirs and assigns, as appurtenant to the said land <br />of the Grantee. <br />
