STATEMENT OF PURPOSE. The purpose of this Permit is to set forth the terms and conditions, under which the Permittee may construct, maintain, repair, and utilize the following described installation/improvement which will infringe upon a public utility easement: To access the City's public utility easement areas for installation of fiber cable to serve 1301 and 1325 Carol Street, along with 1316 Carol Street, 1324 Carol St, 1308 Carol Street, and 1302 Carol Street, in connection with ALLO, Project 968627, per the attached Exhibit "A" Dated 04/11/2023 and consisting of eight (8) pages. 2. DESCRIPTION OF PERMITEE'S UTILITY LOCATION. The Permittee owns the infrastructure within the Permitor's public utility easement to which this Right-of-Way/Easement Utiliy Permit shall apply: LOT FIVE (5) AND SIX (6) OF RHOADS SUBDIVISION, CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA. AND LOTS ONE (1), TWO (2), THREE (3), AND FOUR (4) OF RHOADS SECOND SUBDIVISION TO THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA 3. PERMITEE'S DUTIES AND RISKS. It is understood and agreed that the Permittee may construct, maintain, repair and utilize the above described installation/improvement at the Permittee's sole risk. The Permittee hereby waives any claim for damages against the Permitor, its officers, employee, agents and independent contractors for any damage or injury that may result to said installation/improvement.
