Rief ("Affiant"), being first duly sworn on oath, and by virtue of his personal knowledge, deposes and states as follows: l‘4 1. This Affidavit is executed and recorded solely for the purpose of correcting a scrivener's error. 2. Affiant is the sole and managing member of Innate Development 2 L.L.C., Innate 3 L.L.C., Innate 4 L.L.C., Innate 5 L.L.C., and Innate 6 L.L.0 (which entities are collectively referred to as the "Subdivider") . 3. On March 16, 2023 Affiant, on behalf of Subdivider, executed the Subdivision Agreement for Legacy 34 Third Subdivision in the City of Grand Island, Hall County Nebraska (the "Subdivision Agreement"). 4. On March 20, Roger G. Steele, Mayor of the City of Grand Island, Nebraska, a municipal corporation, executed the Subdivision Agreement. 5. On March 30, 2023 the Subdivision Agreement was recorded at the Hall County Register of Deeds as Instrument No. 202301491. 6. The Subdivision Agreement mistakenly identifies the subject property in Legacy 34 Third Subdivision as LOTS 1-28 Inclusive and Outlots A -J Inclusive. The correct description is LOTS 1-28 Inclusive and Outlots A, D -M Inclusive. 7. The Subdivision Agreement mistakenly identifies the property in Legacy 34 Second Subdivision (subdivided into Legacy 34 Third Subdivision) as LOTS 1-23 Inclusive and Outlots A -J Inclusive. The correct description is LOTS 1-23 Inclusive and Outlots A, D -J Inclusive. FURTHER AFFIANT SAYETH NOT.
