Connick <br />104 N Wheeler Ave. <br />Grand Island, NE 68801 <br />EASEMENT AGREEMENT <br />410 <br />THIS EASEMENT AGREEMENT ("Easement") is made as of this 14th day of April, <br />2023, by and between Eric T. Greenwalt, a single person, ("Grantor") and Gregory P. Greenwalt, <br />a single person, ("Grantee"). <br />WHEREAS, Grantor is the fee simple owner of a tract of land legally described as set <br />forth on Exhibit A attached hereto and referred to herein as "Parcel 1"; <br />WHEREAS, Grantee is the fee simple owner of a tract of land legally described as set <br />forth on Exhibit B attached hereto and referred to herein as "Parcel 2"; and <br />WHEREAS, Grantor desires to grant an easement across Parcel 1 for the benefit of Parcel <br />2 to provide for ingress and egress to Parcel 2; <br />NOW THEREFORE, Grantor hereby makes the following grant of easement rights: <br />1. Grant of Easement. Subject to the terms and conditions set forth in this <br />Agreement, Grantor hereby grants an easement across Parcel 1 for the benefit of Parcel 2 to <br />provide for ingress and egress to Parcel 2. The area of the easement granted hereby shall <br />hereinafter be referred to as the "Easement Area" and shall consist of: (a) an approximately 20 ft. <br />roadway, the area and configuration of which is more particularly described on Exhibit C <br />attached hereto. <br />2. Scope of Easement. The easement in the Easement Area granted herein is for the <br />benefit of the fee simple owner of Parcel 2, along with its successors and assigns, (collectively <br />"Parcel 2 Owner") and constitutes a permanent non-exclusive easement in, over and through the <br />Easement Area, permitting the use of the Easement Area by Parcel 2 Owner, along with its <br />agents, employees, tenants, and invitees, for the purposes of ingress and egress to Parcel 2 for <br />normal and reasonable use of Parcel 2. The rights granted herein with regard to the Easement <br />Area shall burden the fee simple owner of Parcel 1, along with its successors and assigns, <br />tenants, licensees and permittees (collectively "Parcel 1 Owner"). The Easement Area shall be <br />used by Parcel 2 Owner, along with its agents, employees, tenants, and invitees, solely for the <br />purposes set forth herein. <br />3. Maintenance. The Easement Area shall be maintained and kept in at least as good <br />a condition as it is presently in. The responsibility and expense for the repair and maintenance of <br />the Easement Area shall be borne equally between Parcel 1 Owner and Parcel 2 Owner. <br />4. Additional Terms. The Easement shall be subject to the following terms and <br />conditions: <br />a. The Easement shall be permanent and shall be appurtenant to and run with the <br />title to the land. <br />b. Parcel 1 Owner shall pay all real estate taxes associated with the Easement Area <br />as part of the general assessments against Parcel 1. <br />1 <br />
