202301811 <br />the West line of said Southwest Quarter; thence S 00°1727" W on said <br />West line a distance of 44.60 feet to the Point of Beginning. <br />WHEREAS, Gregory is presently the owner of record of the following described <br />real estate (as it is a part of the North Tract), hereinafter referred to as "Easement Area": <br />A tract of land being part of the Northwest Quarter of the Southwest Quarter <br />(NW 1 /4 S W 1 /4) of Section Fourteen (14), Township Twelve (12) North, Range <br />Twelve (12) West of the 6th P.M., Hall County, Nebraska, being more <br />particularly described as follow: <br />Commencing at the Southwest corner of the Northwest Quarter of the <br />Southwest Quarter of said Section 14 and assuming the West line of said <br />Southwest Quarter as bearing N 00°17'27" E and all bearings contained <br />herein are relative thereto; thence N 00°17'27" E on the West line of said <br />Southwest Quarter a distance of 44.60 feet to the POINT OF <br />BEGINNING; thence continuing N 00°17'27" E a distance of 20.08 feet; <br />thence S 84°36'10" E a distance of 215.68 feet; thence S 25°09'09" W a <br />distance of 21.25 feet; thence N 84°36'10" W a distance of 206.71 feet to <br />the Point of Beginning. <br />WHEREAS, the parties hereto acknowledge and agree that the Easement Area is <br />a driveway which provides ingress and egress access to North Tract and South Tract from <br />the county road. <br />NOW, THEREFORE, it is hereby agreed as follows: <br />1. The foregoing recitals are incorporated herein by this reference. <br />2. Gregory hereby grants unto Eric, along with Eric's invitees, agents, and <br />employees and all parties subsequently claiming ownership of the South Tract, a <br />nonexclusive perpetual easement over, through and upon Easement Area for reasonable <br />ingress and egress from the county road. <br />3. The Easement Area shall be maintained and kept in at least as good a <br />condition as it is presently in. The responsibility and expense for the repair and <br />maintenance of the Easement Area shall be borne equally between Gregory (or <br />subsequent owner of the North Tract) and Eric (or subsequent owner of the South Tract). <br />4. Each party hereto agrees to indemnify and hold the other parties hereto <br />harmless from any and all claims and demands of whatsoever nature which may be <br />asserted against any other party hereto by virtue of such party's (or their invitees, agents, <br />and employees) use of the Easement Area as permitted herein. <br />5. The easement as granted herein shall be a perpetual easement, is <br />nonexclusive and shall run with the land and shall inure to and be binding upon the <br />parties hereto, their heirs, successors and assigns and all parties claiming ownership of <br />North Tract, South Tract, or the Easement Area through the parties hereto. <br />Dated this % day of April, 2023. <br />ric T.
