The Subdivider agrees that within the CD <br />Commercial Development Zone, lots 23-28 inclusive shall be consistent with the designs approved <br />with the development plan including one principal building per lot as shown in the attached <br />development plan and attached elevations and floor plans and four carriage houses with one dwelling <br />unit in each carriage house. No portion of any building constructed (including architectural features) <br />shall exceed a height of 50 feet above the center of the street at the midpoint of the front property <br />line. Lot 22 is zoned B2 General Business and shall conform to the rules and regulations of Chapter <br />36 as they apply. <br />11. Access. No access shall be permitted directly to any lot from Husker <br />Highway. <br />12. Easements. Any easements shall be kept free of obstructions and the <br />Subdivider shall indemnify the City for any removal or repair costs caused by any obstructions. In <br />addition, the duty to maintain the surface of any easements to keep them clear of any worthless <br />vegetation or nuisance shall run with the land. <br />13. Engineering Data. All final engineering plans and specifications for public <br />improvements shall bear the signature and seal of a professional engineer registered in the State of <br />Nebraska and shall be furnished by the Subdivider to the Department of Public Works for approval <br />prior to contracting for construction of any improvements. Inspections of improvements under <br />construction shall be performed under the supervision of a professional engineer registered in the <br />5 <br />
