PUBLIC LANDSCAPE EASEMENT
<br />THE EATING ESTABLISHMENT, GRAND ISLAND SOUTH, LIMITED PARTNERSHIP, herein called the
<br />Grantor, in consideration of Ten Dollars ($ 10.00 ) and other consideration, receipt of which is hereby
<br />acknowledged, hereby grants and conveys unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall County, State of Nebraska, herein called the Grantee, a permanent and perpetual
<br />easement and right -of -way to construct, operate, maintain, extend, repair, replace, and remove landscaping items,
<br />including but not limited to, trees, shrubs, flower beds; grasses, underground irrigation systems, paver bricks, and
<br />other appurtenances, upon, over, along, across, in, underneath and through a tract located in part of Lot 1 Runza
<br />Subdivision, in Section Twenty Eight (28), Township Eleven (11) North, Range Nine (9) West of the 6`h P.M., in
<br />the City Of Grand Island, Hall County, Nebraska; the easement and right -of -way being more particularly described
