200110165 <br />DEED OF TRUST NOTE <br />$55,000.00 /0 _ d Q - , 2001 <br />FOR VALUE RECEIVED, the undersigned promises to pay to Doyle L. and <br />Violet B. Winfrey, Trustees, the principal sum of FIFTY FIVE THOUSAND AND <br />NO /100 DOLLARS ($55,000.00), with interest from the date hereof, as follows: <br />2001. <br />THREE THOUSAND AND NO /100 DOLLARS ($3,000.00) paid September 18, <br />Monthly installments of $400.00 commencing October 12001, until paid in full. <br />The outstanding balance herein will carry an interest rate of 7% per annum. A <br />copy of an amortization schedule using the 7% rate is attached to the Contract for Sale of <br />Real Estate, signed by the parties and incorporated hereof. <br />This Note is secured by a Deed of Trust of even date and in the same principal <br />amount as herein stated, executed by Elvia Galaviz in respect to the following- described <br />property: <br />The Easterly Forty -Seven (E47') of the Southerly Eighty Feet (S80') <br />of Fractional Lot Nine (9) in Fractional Block Nineteen (19) in H. G. <br />Clark's Addition to the City of Grand Island, Hall County, Nebraska, <br />and its complement: Fractional Lot Eight (8) in Fractional Block Six (6) <br />in Rollins' Addition to the City of Grand Island, Hall County, Nebraska, <br />being a rectangular tract of ground having a Southerly frontage of Forty- <br />Seven Feet (47') on Sixth Street, in said City, and a depth of Eighty <br />Feet (80'). <br />In case of default in the payment of any installment of either principal or interest <br />or in the performance of any of the covenants, conditions or agreements contained in the <br />Deed of Trust given to secure the payment hereof, then, or at any time thereafter during <br />the continuance of such default, the legal holder hereof may, after ten (10) days written <br />notice of default to the said Elvia Galaviz, declare the whole debt immediately due and <br />payable. In the event that title to the above - described property is transferred or <br />contracted to be transferred from the undersigned for any reason, or by any method <br />whatsoever, the entire principal sum and accrued interest shall at once become due and <br />payable at the election of the holder hereof. If the legal holder hereof at any time deems <br />Buyer insolvent or insecure, the entire unpaid principal balance of this Note shall, at the <br />option of the holder hereof, become immediately due and payable. <br />All makers and endorsers waive presentment, demand, protest and notice and the <br />benefit of any homestead, exemption valuation or appraisement laws as to this debt. <br />(fjv,eW <br />ELVIA GALAVIA <br />
