<br />THIS DEED OF TRUST is made as of the 29th day of December, 2022. The Trustor
<br />(whether one or more) is USHER INVESTMENTS, L.L.C., whose address for purposes of
<br />notices in respect to this Deed of Trust is 3205 West North Front Street, Grand Island, Nebraska
<br />68803 and is sometimes identified herein as "Borrower". The Trustee is KEVIN P. WALSH,
<br />Attorney at Law and member of the Nebraska State Bar Association, whose address is 104 N.
<br />Wheeler Avenue, Grand Island, Nebraska 68801. The Beneficiary is RANDY L. EVANS and
<br />CYNTHIA S. EVANS, husband and wife, as joint tenants with rights of survivorship, whose
<br />address for purposes of notification under this Deed of Trust is 1823 W. Koenig, Grand Island,
<br />Nebraska 68803 and is sometimes identified herein as "Lender".
<br />BORROWER IRREVOCABLY CONVEYS TO TRUSTEE, IN TRUST, WITH
<br />POWER OF SALE, THE FOLLOWING:
<br />Lot One (1), Block Seven (7), Spaulding and Gregg's Addition to the City of Grand
<br />Island, Hall County, Nebraska, and Lot Two (2), Block Seven (7) Spaulding and Gregg's
<br />Addition to the City of Grand Island, Hall County, Nebraska, and Fractional Lot Two (2),
<br />Block Nineteen (19), in Palmer's Subdivision of Lot Seven (7), of County Subdivision of
<br />the Southeast Quarter of the Southwest Quarter (SE1/4SW1/4) of Section Sixteen (16),
<br />Township Eleven (11) North, Range Nine (9) West of the 6th P.M., Hall County,
<br />Nebraska, Excepting a tract as shown in Return of Appraisers filed as Document No.
<br />200702645; and
<br />Fractional Lots Three (3) and Four (4), in Block Nineteen (19), in Kernohan and
<br />Decker's Addition to the City of Grand Island, Hall County, Nebraska, and Fractional Lot
<br />Three (3) and Fractional Lot Four (4), in Block Seven (7), Spaulding and Gregg's
<br />Addition to the City of Grand Island, Hall County, Nebraska, and Fractional Lots Three
<br />(3) and Four (4), Block Nineteen (19), in Palmer's Subdivision to the City of Grand
<br />Island, Hall County, Nebraska, Excepting a tract as shown in Return of Appraisers filed
<br />as Document No. 200702645,
<br />together with all buildings, improvements, fixtures, streets, alleys, passageways, easements,
<br />rights, privileges, and appurtenances located thereon or in anywise pertaining thereto, and the
<br />rents, issues and profits, reversions and remainders thereof, and such personal property that is
<br />attached to the improvements so as to constitute a fixture, including but not limited to heating
<br />and cooling equipment, and together with the homestead or marital interests, if any, which
<br />interests are hereby released and waived; all of which, including replacements and additions
<br />thereto, is hereby declared to be a part of the real estate secured by the lien of this Deed of Trust
<br />and all of the foregoing being referred to herein as the "Property".
<br />This Deed of Trust secures the total sum of One Million and No/100 Dollars
<br />($1,000,000.00) (hereinafter referred to as "Debt") as evidenced by Borrower's Deed of Trust
<br />Note dated December 30, 2022 (herein called "Note"), which has a stated maturity date of
