<br />AFFIDAVIT
<br />COMES NOW, Andrew M. Zoucha and Todd F. Kramer, Trust Officer on behalf of
<br />Cornerstone Bank, being first duly sworn upon oath, deposes and states that:
<br />1. Affiants are the Co -Trustees of the Norbert J. Zoucha Irrevocable Trust, and the
<br />Co -Trustees of the Elizabeth L. Zoucha Irrevocable Trust.
<br />2. Said trusts are the owners of the following described real estate, to wit:
<br />A tract of land comprising a part of the NE1/NE'/ of Section 35, Township 11
<br />North, Range 9 West of the 6th P.M., Hall County, Nebraska, more particularly
<br />described as follows: Beginning at the Northeast corner of said NE'/NE1A; thence
<br />running Southerly on the East line of said NE%NE',4, on an Assumed bearing of
<br />S00°27'32"E, a distance of 566.80 feet to the ACTUAL point of beginning;
<br />thence continuing SO0°27'32"E on the East line of said NE'''%NEIA, a distance of
<br />442.84 feet; thence running N87°23'39"W, a distance of 348.14 feet; thence
<br />running N41 °39'27"W, a distance of 135.94 feet; thence running S86°03'09"W, a
<br />distance of 461.45 feet; thence running S87°21'02"W, a distance of 426.81 feet to
<br />a point on the West line of said NE%ANE%A; thence running N00°34'34"W, on the
<br />West line of said N E'ANE'A, a distance of 877.32 feet to a point on the Southerly
<br />right of way line of Highway No. 34; thence running S89°32'59"E, on the
<br />Southerly right of way line of Highway No. 34, a distance of 1117.53 feet to a
<br />point on the West line of Niedfelt First Subdivision; thence running S00°29'44"E,
<br />on the West line of Niedfelt First Subdivision, a distance of 491.96 feet to the
<br />Southwest corner of Lot 3, Niedfelt First Subdivision; thence running
<br />N89°53'48"E, on the South line of Lot 3, Niedfelt First Subdivision and its
<br />extension, a distance of 208.36 feet, to the ACTUAL point of beginning; less Lot
<br />1, Darlings Landing Subdivision, Hall County, Nebraska
<br />3. As Co -Trustees of the Trusts, the undersigned knows that (a) there are presently,
<br />and have been since the inception of the Trusts, no other trustees appointed to serve on behalf of
<br />the Trusts and that the Affiants are the Co -Trustees at this time; (b) said Trusts have not been
<br />revoked, amended or terminated and are in full force and effect; and (c) said Trust Agreements
<br />contain the appropriate language which provides authority for the undersigned to convey the
<br />above-described real estate.
<br />4. Affiants further state that the undersigned are the Co -Trustees of said Trusts and
<br />that there have been no substitutions of Trustees, and that the iuidersigned are still authorized and
<br />fully empowered to act on behalf of the beneficiaries of such Trusts in carrying out the terms of
<br />said Trusts, including, but no limited to, the conveyance of the above-described real estate.
