Dunn <br />RESTRICTIVE COVENANT <br />WHEREAS, the undersigned, Bosselman Pump & Pantry, Inc., fka Bosselman, Inc., a <br />Nebraska corporation ("Bosselman") is the titleholder of record of the following -describe real <br />estate (the Property): <br />N <br />cD <br />N <br />N <br />G <br />co <br />Ul <br />CO <br />Lot 8, Woodland Second Subdivision, Grand Island, Hall County, Nebraska. •, <br />WHEREAS, Bosselman desires to provide for a restriction on the use of the Property; and �- <br />WHEREAS, Bosselman desires to establish a term for the restriction on the use of Cher <br />Property as provide herein. <br />NOW, THEREFORE, effective as of the date this Restrictive Covenant is filed of record <br />with the Register of Deeds of Hall County, Nebraska: <br />1. Restriction on Use. The Property shall not be used and no improvements <br />will be constructed on the Property to permit the Property to be used for (i) the storage, sale, <br />marketing or distribution of gasoline, diesel, ethanol or any blend thereof, electricity or propane <br />(collectively, "Fuel") for the propulsion of motor vehicles; (ii) the sale at retail of alcoholic <br />beverages; or (iii) the washing or detailing of cars, trucks or other motor vehicles. <br />2. Term of Restriction. The foregoing restriction shall commence on the date <br />of filing of this Restrictive Covenant with the Register of Deeds of Hall County, Nebraska and <br />shall remain in full force and effect for a period ending on the date twenty-five (25) years after <br />such date. <br />3. MISCELLANEOUS: <br />a. This Restrictive Covenant and restrictions shall run with the Property and shall be <br />binding upon and enforceable by any adjacent property owner and/or Bosselman <br />and their respective heirs, personal representatives, successors and assigns. <br />b. The enforcement of these covenants and restrictions shall be by proceedings at law <br />or in equity against any person or persons violating or attempting to violate any <br />
