Walsh <br />`// 104 N Wheeler Avenue <br />Grand Island NE 68801-6015 <br />AMENDMENT TO DECLARATION OF SOUTHEAST COMMONS BUSINESS <br />CONDOMIUMS <br />ri <br />�a °° <br />THIS AMENDMENT is made this day of I%-ec e-vn / -L.(, 2022, by the <br />undersigned, being the Declarant under that certain DECLARATION OF SOUTHEAST <br />COMMONS BUSINESS CONDOMINIUMS, (hereinafter referred to as "Declarant") for <br />themselves and for their successors, grantees, and assigns. <br />WITNESSETH: <br />WHEREAS, that certain DECLARATION OF SOUTHEAST COMMONS BUSINESS <br />CONDOMINIUMS (hereinafter referred to as "the Declaration") was filed in the Office of the <br />Register of Deeds of Hall County, Nebraska, on July 12, 2021, as Instrument No. 2021005872, <br />which Declaration was recorded against the following described real estate, to -wit: <br />Lots One (1) and Three (3), Fonner Third Subdivision, in the City of Grand Island, <br />Hall County, Nebraska, excepting therefrom tracts of land more particularly <br />described in Warranty Deed recorded as Document No. 82-003073, Warranty Deed <br />recorded as Document No. 95-105533 and Warranty Deed recorded as Document <br />No. 200316358; and <br />WHEREAS, Section 6. of the Declaration provides that the Declarant may construct <br />additional buildings in the Common Areas, as identified in the plat and plans attached to the <br />Declaration, and create additional units; and <br />WHEREAS, the Declarant desires to add an additional unit to the condominium; and <br />WHEREAS, Declarant desires to amend the Declaration to add said unit. <br />KNOW ALL MEN BY THESE PRESENTS: <br />1. Section 4. of the Declaration is hereby amended to read as follows: <br />4. Boundaries. The boundaries of each unit, including the unit's identifying <br />number, are shown on Exhibit "A" (plat and plan). The boundaries of units within <br />the building are the unfinished surface of the outermost interior walls, fireplace <br />openings, if any, up to the flue in a closed position, the unfinished surface of the <br />basement floor, the unfinished surface of the ceiling immediately below the roof as <br />indicated for each separate unit upon the attached Exhibit "A", and the extension <br />of those surfaces where the unit includes unenclosed space while the boundaries of <br />Page 1 of 4 <br />
