202208217 <br />LAND LEASE AGREEMENT FOR OUTDOOR ADVERTISING <br />This Lease Agreement for Outdoor Advertising is made on this 11"11, day of <br />February, 2008, by and between MARK AND DIANE MEANS, husband and wife, whose <br />address is 4576 W. Hwy 30, Grand Island, Nebraska 68803 ("LESSOR") and USA <br />OUTDOOR, L.L.C., a Nebraska Limited Liability Company, whose address is 409-411 E. <br />25th Street, Suite#5, Kearney, NE 68847 ("LESSEE"). <br />(308) 385-0680 Home or (308) 383-9923 Mark's cell <br />1. Location: In consideration of the rent provided for in this Lease, LESSOR leases to <br />LESSEE that portion of real estate belonging to LESSOR located in Grand Island, Hall <br />County, Nebraska, at the address of is 4576 W. Hwy 30, Grand Island, Nebraska, which is <br />located on the real estate described as follows: <br />Lot # 1 of Elrod Subdivision (a/k/a 4576 W. US Hwy 30), Grand Island, Hall <br />County, Nebraska. <br />Provided, if the legal description of the real estate is not available at the time said Lease is <br />signed by LESSOR, then LESSOR agrees to provide the legal description of the real <br />estate to LESSEE within ten (10) days of the date this Lease is signed by LESSOR. <br />2. Term: The term of this Lease shall be for a period of ten (10) years from the date <br />this Lease Agreement is made. Provided, that this Lease shall automatically renew for <br />five (5) consecutive five-year terms unless written notice is given to LESSOR by <br />LESSEE thirty (30) days prior to the date of the next yearly anniversary of the start date <br />when the term will expire. If said LESSOR shall sell the above -referenced real estate any <br />time during this Agreement, the new LESSOR shall honor all terms and conditions of this <br />Agreement. The new LESSOR shall provide LESSEE with the correct payee information <br />for all future payments to be made. <br />3. Rent: LESSEE shall pay to LESSOR an annual rent of ($1,200.00) per year <br />payable in monthly installments of ($100.00), providing, the first monthly rental payment <br />will not be due and payable until the LESSEE'S outdoor advertising structure has been <br />completely erected ("start date"). Then, the monthly rental payments will be due on the <br />same date for each successive month ("start date anniversary"). <br />4. Use of Real Estate: LESSEE shall use the leased property for the construction <br />and maintenance of an outdoor advertising structure. In connection with this use the <br />LESSEE, its employees and agents, shall have the right of reasonable access to and <br />egress from the real estate where the outdoor advertising structure is located. In <br />connection with this use, LESSEE agrees to keep the real estate in good appearance and <br />shall maintain it at all times in a clean and attractive condition. LESSEE shall have first <br />option to erect any additional advertising structures on the leased property. <br />5. Ownership: All equipment and materials placed upon the leased real estate by <br />LESSEE shall remain the property of LESSEE and may be removed by it at any time prior <br />to or within a reasonable time after the expiration of the final term of this Lease. LESSEE <br />shall have the right to make any necessary applications with, and obtain permits from, <br />governmental bodies for the construction and maintenance of LESSEE'S advertising <br />structure, at the sole discretion of LESSEE. All permits shall be and remain the property <br />of LESSEE. LESSOR warrants and represents that he is the owner of the leased real <br />
