202207982 <br />LIMITED POWER OF ATTORNEY <br />JOSE E. MARTINEZ of 1359 W. University Blvd., Suite A-210, Odessa, Texas 79764, the <br />Principal, hereby creates this Limited Power of Attorney for the purpose of enabling the Agent <br />named below to act as the Principal's agent and attorney-in-fact for the limited purpose set forth <br />in section 3 below. <br />1. Designation of Agent. The Principal hereby designates and appoints Maria Martinez - <br />Hernandez of 300 E. White, Apt. 204-E, Hobbs, New Mexico 88240 to be the Principal's agent <br />and attorney-in-fact to act in the Principal's name and stead for the limited purpose set forth in <br />section 3 below. <br />2. Effective Date. This Limited Power of Attorney and powers conferred herein shall be <br />effective as of the date of the execution of this Limited Power of Attorney by the Principal, <br />which date is set forth below. <br />3. Purpose of Power of Attorney. The sole purpose of this Power of Attorney is to enable <br />the Agent to act as the Principal's agent and attorney-in-fact for the limited function of obtaining <br />information and make any changes regarding the mortgage account with Wells Fargo Bank, <br />Grand Island, Nebraska; Account No.: 7080114403645, wherein the real property has been <br />awarded to Maria Martinez -Hernandez pursuant to a Marital Settlement Agreement filed January <br />6, 2022, and a Final Decree of Dissolution of Marriage filed January 10, 2022, in Maria <br />Hernandez de Martinez vs. Jose E. Martinez; Lea County District Court Case No. D -506 -DM - <br />2022 -00011 in Lovington, New Mexico. <br />4. Power of Agent. The Agent serving under this Limited Power of Attorney shall have all <br />of the powers, rights, discretions, elections and authority confirmed by statute, the common law, <br />or rule of court or governmental agency that are reasonably necessary to enable the Agent to <br />carry out the purpose of this Limited Power of Attorney. In addition, the Agent shall have the <br />following specific powers: <br />A. The power to collect and receive all funds, debts, monies, accounts, objects, <br />interests, or demands due to the Principal in connection with the function described in <br />section 3 above. <br />B. The power to endorse the Principal's name for deposit into an account of the <br />Principal in a financial institution with respect to any funds, checks, drafts or other sums <br />payable to the Principal in connection with the function described in section 3 above. <br />C. The power to sign, execute, seal, acknowledge and deliver any written document <br />necessary or expedient to carry out the function described in section 3 above. <br />
