COUNTY OF HALL ) NL j<AuPSI` The undersigned affiant, upon being first duly sworn, does hereby depose and state: R Tat r 1. The value of all of the personal property in the estate of Diane M. Nowka, Deceased, wherever located, less liens and encumbrances, which is subject to probate proceedings, does not exceed $100,000.00. 2. Thirty days have elapsed since the death of the Decedent. A certified or authenticated copy of the decedent's death certificate is attached to this Affidavit. 3. No application or petition for the appointment of a Personal Representative is pending or has been granted in any jurisdiction. 4. Affiant is entitled to payment and delivery of all personal property held by others in the sole name of the Decedent pursuant to Nebraska Probate Code Section 30-24,125. Affiant's entitlement to personal property is based on his status as spouse. 5. Pursuant to the Nebraska Probate Code Section 30-24,126, the person paying, delivering, transferring or issuing personal property or the evidence thereof pursuant to this affidavit is discharged and release to the same extent as if said person dealt with a Personal Representative of the Decedent; said person is not required to see to the application of the personal property or evidence thereof or to inquire into the truth of any statement in this affidavit. 6. Affiant covenants and agrees to distribute the property, less lawful debts and expenses, to the persons entitled to the same under Nebraska or other applicable law. 7. For and in consideration of the transfer and delivery of said property to the undersigned, the undersigned does hereby agree to indemnify and save harmless payor from and against any and all demands, liability, loss, cost, damage or expenses of whatever nature or kind, including attorney's fees, which the said payor is or may be, at any time, put to by reason of the transfer and delivery of said property as aforesaid. 8. The information and statements in the Affidavit are true and material.
