202206706 <br />DECLARATION OF COVENANTS AND RESTRICTIONS <br />THIS DECLARATION OF COVENANTS AND RESTRICTIONS (the "Covenants") is made <br />this IG day of $c.p4c..br. , 2022 by JWCA Holdings, a Nebraska limited liability <br />company. <br />KNOWN ALL MEN BY THESE PRESENTS: <br />I. <br />DESCRIPTION OF LAND <br />The land subject to the Covenants is legally described as: <br />Lots One (1), Two (2), Three (3), Four (4), Five (5), Six (6) and Seven (7), <br />Homesteader Subdivision, Hall County, Nebraska, <br />individually a "Lot" and collectively the "Lots" <br />II. <br />DECLARATION OF PURPOSE <br />The purpose of the Covenants is to protect and provide for the beneficial development, <br />improvement, occupancy and use of the Lots. <br />III. <br />COVENANTS AND RESTRICTIONS <br />The Lots shall be and are subject to the following covenants and restrictions: <br />1. Water shall not be discharged, pumped, channeled, directed or drained in any <br />manner to cause water to leave the boundaries of a Lot and drain onto or across <br />another Lot, or adjacent property. <br />2. No Lot shall be subdivided or split to create smaller lots without the prior written <br />consent of the owners of ALL Lots, which written consent shall be recorded with <br />the Hall County Register of Deeds in order to be effective. <br />3. All construction and building activity shall be performed in compliance with all <br />applicable building codes and ordinances of the City of Grand Island, Nebraska. <br />4. No sign of any kind shall be erected, placed or displayed on a Lot to advertise or <br />promote any commercial activity or business. Political signs shall be permitted <br />within six (6) weeks of a federal, state, or local election. No sign shall contain <br />profane language. <br />5. No worn out or discarded automobiles, tires, machinery, or parts thereof, junk <br />piles may be stored in a location so as to be visible by another Lot. <br />6. No building, or dwelling shall be moved onto a Lot. No pre -fab, modular, <br />manufactured or mobile home shall be placed on a Lot; no trailer, tent, garage, <br />shack or any other unsightly outbuilding shall be used as a dwelling at any time, <br />nor shall any structure of a temporary nature be used as a residence <br />7. Firearms shall only be discarded on any Lot in accordance with federal, state or <br />local law. Firearms shall be only be discharged between the hours of 8:00 a.m. <br />and 8:00 p.m. <br />2 <br />
