Stat. 76-201): <br />Lot Three (3), Block One (1), The Orchard Subdivision, in the City of Grand Island, Hall <br />County, Nebraska <br />GRANTOR covenants jointly and severally with GRANTEE that GRANTOR <br />a. is lawfully seised of such real estate and that it is free from encumbrances, subject <br />C) to easements, reservations, covenants and restrictions of record; <br />• <br />b. has legal power and lawful authority to convey the same; and <br />?> c. warrants and will defend title to the real estate against the lawful claims of all <br />f, persons; and, <br />• <br />J d. For one year from date Grantor warrants to Grantee that the residence on the <br />premises has been completed in a good and workmanlike manner substantially in <br />—+ accordance with applicable building codes and zoning ordinances and in <br />accordance with the plans and specifications as modified by change orders under <br />a written limited warranty which is incorporated herein by this reference. This <br />Limited Warranty is the only express warranty provided by the builder, <br />Grantor. This warranty takes the place of all other warranties express or <br />implied including any warranties of i) merchantability, ii) fitness for a <br />particular purpose, or Hi) implied warranty of habitability. Grantor is not <br />under any circumstances responsible for and Grantee waives all claims to <br />INCIDENTAL AND/OR CONSEQUENTIAL DAMAGES. The warranty <br />provides procedures for claims against the warranty which must be strictly <br />followed.
