Grant Ave., York, NE 68467 (402) 362-4405 <br />AGREEMENT TO RESCIND RIGHT OF FIRST REFUSAL <br />THIS AGREEMENT TO RESCIND RIGHT OF FIRST REFUSAL <br />("Agreement") is made and entered into this 30 day of August, 2022, by and between <br />Larry J. Knuth and Karen L. Knuth, husband and wife (collectively "Knuth"), and <br />Kenneth L. Clausen, a single person ("Clausen"). <br />wit: <br />WHEREAS, Clausen is the owner of the following described real property, to <br />A tract of land comprising a part of the West Half of the Northeast <br />Quarter (W'A NE%) and the West Half of the Southeast Quarter (WY2 <br />SE1/) of Section One (1), Township Ten (10) North, Range Ten (10) West <br />of the 6th P.M., Hall County, Nebraska, more particularly described as <br />follows: <br />Beginning at the Southwest corner of the Southeast Quarter of said <br />Section One (1); thence running easterly along the south line of said <br />Section One (1), on a bearing N 86°49'26" E, a distance of 535.95 feet to <br />the Actual point of beginning; thence N 03°10'36" W, a distance of 164.17 <br />feet; thence N 42°39'30" W on the chord of a curve to the right with a <br />radius of 1311.54 feet, a distance of 750.96 feet; thence S 88°48'42" W, a <br />distance of 32.59 feet; thence N 01°11'18" W, a distance of 1895.02 feet; <br />thence N 69°07'11" E, a distance of 1475.91 feet; thence S 00°39'08" E, a <br />distance of 3090.33 feet; thence S 86°48'26" W, a distance of 825.56 feet <br />to the Actual point of beginning (Clausen Property); <br />WHEREAS, Clausen purchased the Clausen Property from Knuth, and Knuth <br />conveyed the Clausen Property to Clausen by Warranty Deed executed on April 26, <br />2022, and recorded on April 26, 2022, in the office of the Hall County Register of <br />Deeds as Instrument No. 202203071 of Hall County records; <br />WHEREAS, said Warranty Deed was refiled in the Hall County Register of <br />Deeds office on July 27, 2022, and recorded as Instrument No. 202205525 of Hall <br />County records to correct the legal description set forth therein; <br />WHEREAS, as a term and condition of the Agreement for the sale and <br />purchase of the Clausen Property by Clausen from Knuth, and simultaneous with the <br />closing of that sale, Clausen conveyed a right of first refusal to Knuth to purchase the <br />Clausen Property in the event of the sale of the Clausen Property; <br />WHEREAS, the parties executed said Right of First Refusal on April 26, 2022, <br />and it was recorded on April 26, 2022 in the Hall County Register of Deeds' office as <br />Instrument No. 202203073 of Hall County records; <br />Page 1 of 3 <br />ov (i° <br />
