<br />DEED OF TRUST
<br />THIS DEED OF TRUST is made this y of August, 2022, by and among
<br />FREDERICK W. HOTZ, II and PATRICIA K. HOTZ, husband and wife, hereinafter referred to
<br />as "Trustor", whose mailing address is 1115 W. Charles, Grand Island, NE 68801; Denise Myers,
<br />Attomey-at-Law, hereinafter referred to as "Trustee", whose mailing address is 415 S. High Street,
<br />P.O. Box 505, Cairo, Nebraska 68824; and JEFFREY S. HELLEBERG and CAROL M.
<br />HELLEBERG, husband and wife, hereinafter referred to as "Beneficiary", whose mailing address
<br />is 7312 W. 66th St., Sioux Falls, SD 57106.
<br />For valuable consideration, Trustor irrevocably grants, transfers, conveys and assigns to
<br />Trustee, in trust, with power of sale, for the benefit and security of Beneficiary, under and subject
<br />to the terms and conditions of this Deed of Trust, the Trustor's interest in the following -described
<br />property located in the County of Hall, Nebraska, to -wit:
<br />Lot Fourteen (14), in Farrington Subdivision, City of Grand Island, Hall County,
<br />Nebraska.
<br />together with all improvements, fixtures and appurtenances located thereon or in any way
<br />pertaining thereto, and the rents, issues, profits, reversions and the remainders thereof, including
<br />all such personal property that is attached to the improvements so as to constitute a fixture, all of
<br />which, including replacements and additions thereto, are hereby declared to be a part of the real
<br />estate conveyed in trust hereby, it being agreed that all of the foregoing shall be hereinafter
<br />collectively referred to as the "Property".
<br />This Deed of Trust shall secure (a) the payment of indebtedness evidenced by Trustor's
<br />Promissory Note of even date herewith in the principal sum of TWO HUNDRED TWENTY TWO
<br />THOUSAND ONE HUNDRED TWENTY-FIVE and 73/100 DOLLARS ($222,125.73) which
<br />note is payable upon written demand of the Beneficiary, and any and all modifications, extensions,
<br />and renewals thereof or thereto, and any and all future advances and re -advances to Trustor
<br />hereunder; (b) the payment of other sums advanced by Beneficiary to protect the security of the
<br />Note; (c) the performance of all covenants and agreements of Trustor set forth herein; and (d) all
<br />present and future indebtedness and obligations of Trustor to Beneficiary, whether direct, indirect,
<br />absolute, or contingent and whether arising by note, guaranty, overdraft, or otherwise. The Note,
<br />this Deed of Trust, and any and all other documents securing the Note or otherwise executed in
<br />connection therewith, including without limitation guarantees, security agreements, and
<br />assignments of leases and rents, shall be referred to herein as the "Loan Instruments".
<br />To protect the security of this Deed of Trust, Trustor hereby covenants and agrees as
<br />follows:
<br />1. Payment of Indebtedness. To pay when due, the principal of, and the interest on,
<br />the indebtedness evidenced by the Note, charges, fees and all other sums as provided in the Loan
<br />Instruments.
