Fenster and Doreen J. Fenster, <br />husband and wife, Grantor, whether one or more, in consideration of One Dollar and other valuable <br />consideration, receipt of which is hereby acknowledged, does hereby grant, bargain, sell, convey and <br />confirm unto Elmer E. Garay and Shelby M. Rickard, as joint tenants with right of survivorship, and <br />not as tenants in common, conveys to Grantee the following described real property in Hall County, NE: <br />The North Twenty -Eight (28) Feet of Lot Two (2), in Block Twenty -Two (22), in Scarffs Addition to West <br />Lawn, in the City of Grand Island, Hall County, Nebraska and a tract of land abutting theron described as <br />follows: Beginning at the Northeast Corner of Lot Two (2), Block Twenty -Two (22), in Scarff s Addition to <br />West Lawn, in the City of Grand Island, Nebraska; thence running West on the North Line of Lot Two (2) a <br />distance of One Hundred Thirty -Two (132) feet to the Northwest Corner of said Lot (2); thence running North <br />on a Prolongation of the West Line of said Lot Two (2), for a distance of Thirty -Seven (37) feet ; thence running <br />East parallel to the North line of Lot Two (2), for a distance of One Hundred Thirty -Two (132) feet to a point <br />on the Easterly Line of said Lot Two (2), if the same were extended to the North; thence South Thirty -Seven <br />(37) feet to the Northeast corner of asid Lot Two (2), such Tract Being a Part of what formerly was West 17th <br />Street in the City of Grand Island, Nebraska, as vacated by the City of Grand Island. <br />To have and to hold the above described premises together with all tenements, hereditaments and <br />appurtenances thereto belonging unto the grantees and to their assigns, or to the heirs and assigns of the <br />survivor of them forever. <br />And the grantor does hereby covenant with the grantees and with their assigns and with the heirs and <br />assigns of the survivor of them that grantor is lawfully seized of said premises; that they are free from <br />encumbrance except covenants, easements and restrictions of record; all regular taxes and special <br />assessments, except those levied or assessed subsequent to date hereof; that grantor has good right and <br />lawful authority to convey the same; and that grantor warrants and will defend the title to said premises <br />against the lawful claims of all persons whomsoever. <br />It is the intention of all parties hereto that in the event of the death of either of the grantees, the entire <br />fee simple title to the real estate shall vest in the surviving grantee. <br />Dated this `, U I DC7 <br />Curt A.
