MAYHEW, husband and wife, hereinafter referred to as the <br />"Licensees." <br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set <br />forth the terms and conditions under which the Licensees may construct, maintain, repair, and <br />utilize the following described improvement which will infringe upon real estate owned by the <br />Licensor: <br />Installation, utilization, and maintenance of a private water service line, <br />connecting the residence at 411 North Wheeler to the City's water line in the <br />Fourth Street right -of -way. <br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensees own the <br />following described real estate adjacent to the Licensor's real estate to which this License <br />Agreement shall apply: <br />A tract of land comprising of the northerly Thirty Four and Eight Tenths (34.8) <br />feet of the westerly Forty Four (44.0) feet of Lot Five (5), Block Thirty Two (32), <br />Original Town, now the City of Grand Island, Hall County, Nebraska. <br />3. LICENSEES' DUTIES AND RISKS. It is understood and agreed that the <br />Licensees may construct, maintain, repair and utilize the above described improvement at the <br />Licensees' sole risk. The Licensees hereby waive any claim for damages against the Licensor, its <br />officers, employees, agents and independent contractors for any damage or injury that may result <br />
