200010301 <br />(B) "Board" or "Board of Directors" means the governing body of the Association. <br />(C) "Bylaws" means the Bylaws of the Association as the same may be amended <br />from time to time, the provisions of which shall be applicable to the Project, attached as Exhibit <br />"C" and incorporated by this reference. <br />(D) "Common Elements" collectively means all portions of the Property other than <br />the Units and includes the Commons Area, Crawl Space and Party Wall. <br />(E) "Common Expenses" means expenditures or liabilities of (i) expenses declared <br />Common Expenses by the Declaration or Bylaws; (ii) all sums lawfully assessed against the <br />Common Elements by the Board; (iii) expenses agreed upon as Common Expenses by the <br />Association; and (iv) any allocations to reserves. <br />(F) "Condominium Documents" means this Declaration, the Bylaws, and the Rules <br />and Regulations. <br />(G) "Declarant" means David C. Huston and Nancy L. Huston, husband and wife and <br />such successors or assigns as may be designated hereafter by Declarant by written notice duly <br />recorded. <br />(H) "Declaration" means this document, together with all addenda, exhibits attached <br />hereto, including, without limiting the generality of the foregoing, the Plats and Plans, and all <br />amendments and supplements hereto or hereafter executed, which documents shall be <br />recorded pursuant to the Nebraska Revised Statutes, as amended. <br />(1) "Member" means every individual or entity who is a record Owner of a fee or <br />undivided fee interest in any Condominium Unit, including Declarant and contract sellers; but <br />not including contract purchasers unless the contract seller relinquishes membership by <br />contract evidence thereof and gives written notice and proof of recording to the Board. If the <br />ownership of a Unit is in more than one name, only one of the Owners shall be considered a <br />Member for voting purposes as provided herein and in the Bylaws ( "Voting Member "). <br />(J) "Owner" means every individual, firm, corporation, partnership, association, or <br />other legal entity, or any combination thereof, who owns one or more Condominium Units, but <br />excluding, however, any such person or entity having an interest therein merely as a Mortgagee <br />(unless such Mortgagee has acquired fee simple title interest therein pursuant to foreclosure or <br />any proceedings in lieu thereof). <br />(K) "Project" or "Condominium" means and includes the Property, the Buildings, all <br />Common Elements, all Units, all Special Declarant Rights, all improvements and structures <br />IPM <br />
