<br />KNOW ALL MEN BY THESE PRESENTS:
<br />THAT Frances Niedfelt, Life Estate, and Elizabeth Falmlen, a single person, and
<br />Francie Niedfelt, now knawn as Francie Niedfelt Ballou, and Russell L. Ballou, spouse
<br />of Francie Niedfelt Ballou, Remaindermen
<br />hereinafter known as the Grantor, whether one or more, for and in
<br />consideration of the sum of THIRTY TWO THOUSAND SIX HUNDRED AND
<br />NO /100 -- -($32,600.00) - -- DOLLARS in hand paid does hereby grant and convey
<br />unto CENTRAL PLATTE NATURAL RESOURCES DISTRICT hereinafter known as the
<br />Grantee and to its successors and assigns a perpetual and assignable right
<br />and easement in the land described below, for the perpetual right, power,
<br />privilege and easement occasionally to overflow, flood and submerge (the
<br />land described below) in connection with the operation and maintenance of
<br />the above mentioned project with all right, title and interest in and to
<br />the structure; and improvements now situated on the land, except fencing;
<br />and
<br />provided that no structures for human habitation shall be constructed or
<br />maintained on the land, that no other structures constructed or maintained
<br />on the land except as may be approved in writing by the representative of
<br />the Grantee in charge of the above mentioned project; and
<br />reserving, however, to the Grantor, their heirs and assigns, all such
<br />rights and privileges as may be used and enjoyed without interfering with
<br />the use of the project for the purposes authorized by the Grantee or
<br />abridging the rights and easement hereby acquired; and
<br />provided further that any use of the land shall be subject to Federal and
<br />State laws with respect to pollution; and
<br />excepting that excavation for the purpose of quarrying sand, gravel, etc.,
<br />shall be permitted, subject only to such approval as to the placement of
<br />overburden, if any, in connection with such excavation; and
<br />the above estate is taken subject to existing easements for public roads
<br />and highways, public utilities, railroads and pipelines; and
<br />situated in Hall County, and State of Nebraska, to wit;
