<br />LICENSE AGREEMENT
<br />This License Agreement is made by and between the CITY OF GRAND ISLAND, NEBRASKA, a
<br />municipal Corporation, herein referred to as the "Licensor" and TRUE NORTH CHURCH, INC., Owner,
<br />hereinafter referred to as the "Licensee".
<br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the
<br />terms and conditions, under which the Licensee may construct, maintain, repair, and utilize the following
<br />described improvement which will infringe upon public right-of-way:
<br />Installation, maintenance, and repair of four (4) trees, two (2) landscaping beds, railroad ties,
<br />chain link fence and underground sprinklers in the public right-of-way abutting the property
<br />addressed as 1804 West State Street, per attached Exhibit "A", dated 2022/4/12 and consisting of
<br />two (2) pages. This agreement is in connection with the Five Points Intersection, Grand Island
<br />Project No. HSIP-5409(3), Control No. 42863.
<br />2. DESCRIPTION OF REAL ESTATE AFFECTED. This License Agreement applies to Lots
<br />1, 3, 5, 7, 8, 9, 10, 11, 12, 13, and 14, Block 29, Gilbert's Third Addition to the City of Grand Island, Hall
<br />County, Nebraska; EXCEPTING a certain tract deeded to the City of Grand Island, more particularly
<br />described in Warranty Deed recorded in Book 152, Page 465; AND EXCEPTING a certain tract deeded
<br />to the City of Grand Island, Nebraska, more particularly described in Quit Claim Deed recorded as
<br />Document No. 81-001071; AND ALSO EXCEPTING a tract deeded more particularly described in
<br />General Warranty Deed recorded as Document No. 201503852, and described as follows: A tract of
<br />land consisting of part of Lot 1, Block 29, Gilbert's Third Addition to the City of Grand Island, Hall County,
<br />Nebraska, and more particularly described as follows: Commencing at the Northeast corner of said Lot
<br />1, said point also being the point of intersection of the South right-of-way line of Waugh Street and the
<br />West right-of-way line of Broadwell Avenue and the point of beginning; thence on an assumed bearing of
<br />S00°54'55"E along said West right-of-way line a distance of 46.00 feet; thence N44°14'43"W a distance
<br />of 23.32 feet; thence S88°56'42"W a distance of 127.47 feet to a point on the West line of said Lot 1;
<br />thence N01°02'23"W along said West line a distance of 29.00 feet to the Northwest corner of said Lot 1,
<br />said point also being on the South right-of-way line of Waugh Street; thence N88°56'42"E along said
<br />South right-of-way line a distance of 143.54 feet to the point of beginning, said tract contains 4297.61
<br />square feet or 0.10 acres, more or less.
