Box <br />5342, Grand Island, Nebraska 68802; Denise Myers, Attorney -at -Law, hereinafter referred to as <br />"Trustee", whose mailing address is P.O. Box 505, 415 S. High Street, Cairo, Nebraska 68824; <br />and BARRY D. SMITH and MELODY L. SMITH, husband and wife, hereinafter referred to as <br />"Beneficiary", whose mailing address is 2202 N. T Road, Marquette, NE 68854. <br />For valuable consideration, Trustor irrevocably grants, transfers, conveys and assigns to <br />Trustee, in trust, with power of sale, for the benefit and security of Beneficiary, under and subject <br />to the terms and conditions of this Deed of Trust, the Trustor's interest in the following -described <br />property located in the County of Hall, Nebraska, to -wit: <br />Lot Nine (9), in Block Seventy (70), in Wheeler & Bennett's Second Addition to <br />the City of Grand Island, Hall County, Nebraska. <br />together with all improvements, fixtures and appurtenances located thereon or in any way <br />pertaining thereto, and the rents, issues, profits, reversions and the remainders thereof, including <br />all such personal property that is attached to the improvements so as to constitute a fixture, all of <br />which, including replacements and additions thereto, are hereby declared to be a part of the real <br />estate conveyed in trust hereby, it being agreed that all of the foregoing shall be hereinafter <br />collectively referred to as the "Property". <br />This Deed of Trust shall secure (a) the payment of indebtedness evidenced by Trustor's <br />note of even date herewith in the principal sum of TWENTY-NINE THOUSAND NINE <br />HUNDRED and NO/100 DOLLARS ($29,900.00) which has a stated maturity date of March 15, <br />2027, and any and all modifications, extensions, and renewals thereof or thereto, and any and all <br />future advances and re -advances to Trustor hereunder pursuant to one or more promissory notes <br />or credit agreements (b) the payment of other sums advanced by Beneficiary to protect the security <br />of the Note; (c) the performance of all covenants and agreements of Trustor set forth herein; and <br />(d) all present and future indebtedness and obligations of Trustor to Beneficiary, whether direct, <br />indirect, absolute, or contingent and whether arising by note, guaranty, overdraft, or otherwise. <br />The Note, this Deed of Trust, and any and all other documents securing the Note or otherwise <br />executed in connection therewith, including without limitation guarantees, security agreements, <br />and assignments of leases and rents, shall be referred to herein as the "Loan Instruments". <br />To protect the security of this Deed of Trust, Trustor hereby covenants and agrees as <br />follows: <br />1. Payment of Indebtedness. To pay when due, the indebtedness evidenced by the <br />Note, interest, charges, fees and all other sums as provided in the Loan Instruments. <br />2. Title. Trustor is the owner of the Property and has the right and authority to execute <br />this Deed of Trust in respect to the Property. The Trustor further warrants that the execution and <br />delivery of this Deed of Trust does not violate any contract or other obligation to which Trustor is <br />subj ect. <br />ND <br />rri <br />re) VI <br />0 <br />
