rn <br />-n <br />2 n C <br />rn > v <br />nLi, •• <br />L' <br />C-. <br />Ci` <br />TI <br />n <br />co <br />PARTNERSHIP JOINT TENANCY WARRANTY DEED <br />with limited warranty of construction <br />The Orchard, LLC, a Nebraska Limited Liability Company, GRANTOR, in consideration of One <br />Dollar and 00/100 and other good and valuable consideration received from GRANTEES, <br />Carolyn J. Wassinger and Nathaniel S. Wassinger, wife and husband, conveys to <br />GRANTEES, as joint tenants with right of survivorship and not as tenants in common, the <br />following described real estate, (as defined in Neb. Rev. Stat. 76-201): <br />Lot eleven (11), Block Four (4), The Orchard Subdivision, in the City of Grand Island, Hall <br />County, Nebraska. <br />GRANTOR covenants jointly and severally with GRANTEES that GRANTOR <br />a. is lawfully seised of such real estate and that it is free from encumbrances, subject <br />to easements, reservations, covenants and restrictions of record; <br />b. has legal power and lawful authority to convey the same; and <br />c. warrants and will defend title to the real estate against the lawful claims of all <br />persons; and, <br />d. For one year from date Grantor warrants to Grantees that the residence on the <br />premises has been completed in a good and workmanlike manner substantially in <br />accordance with applicable building codes and zoning ordinances and in <br />accordance with the plans and specifications as modified by change orders under <br />a written limited warranty which is incorporated herein by this reference. This <br />Limited Warranty is the only express warranty provided by the builder, <br />Grantor. This warranty takes the place of all other warranties express or <br />implied including any warranties of i) merchantability, ii) fitness for a <br />particular purpose, or iii) implied warranty of habitability. Grantor is not <br />under any circumstances responsible for and Grantees waive all claims to <br />INCIDENTAL AND/OR CONSEQUENTIAL DAMAGES. The warranty <br />provides procedures for claims against the warranty which must be strictly <br />followed.
