f:A2203855 <br />EASEMENT AGREEMENT <br />THIS EASEMENT AGREEMENT made and entered into this Z-1.: Y <br />da of <br />H w , 2022, by and between Ellis K Collins and Janelle Collins, husband and <br />wife, ("ntor") and David G. Phelps and Laura G. Phelps, husband and wife ("Grantee"). <br />WHEREAS, Grantor is the owner of the property legally described as Lot Five (5), Block <br />One (1), Jenkinson Subdivision in the City of Grand Island, Hall County, Nebraska ("Grantor's <br />Property"); and <br />WHEREAS, Grantee is the owner of the property legally described as Lot Seven (7), <br />Block One (1), Jenkinson Subdivision in the City of Grand Island, Hall County, Nebraska <br />("Grantee's Property"); and <br />WHEREAS, Grantee utilizes a sump pump line that crosses Grantor's Property in order <br />to connect to the infrastructure of the City of Grand Island. <br />WHEREAS, the parties wish to enter into this Easement Agreement to acknowledge and <br />memorialize the use of said sump pump line by Grantee. <br />NOW, THEREFORE, in consideration of the mutual covenants and agreements of the <br />parties, it is agreed as follows: <br />1. Grantor hereby grants and convey to Grantee a permanent easement upon <br />Grantor's Property for use for a sump pump line, specifically located at: THE EAST 10 FEET <br />OF LOT FIVE (5), BLOCK ONE (1), JENKINSON SUBDIVISION, CITY OF GRAND <br />ISLAND, HALL COUNTY, NEBRASKA, CONTAINING 1288 SQ. FT. MORE OR LESS (the <br />"Easement"). <br />2. Grantee accepts the Easement in "as is" condition. Grantor shall not alter or <br />damage the Easement in a way that frustrates Grantee's use. <br />3. This Easement shall run with the land and shall be binding and inure to the benefit <br />and detriment of the parties to this agreement, their respective heirs, successors and assigns to <br />Grantors' Property and Grantee's Property. <br />4. Grantee agrees to hold Grantor harmless and indemnify Grantor from any and all <br />liability or claims for personal injury or property damage. Grantor shall not be obligated to repair <br />
