co <br />FIRST AMENDMENT TO AMENDED AND RESTATED DECLARATION OF <br />COVENANTS, CONDITIONS AND RESTRICTIONS <br />OF <br />THE VILLAS AT STOLLEY PARK <br />THIS FIRST AMENDMENT TO AMENDED AND RESTATED DECLARATION OF <br />COVENANTS, CONDITIONS AND RESTRICTIONS (this "First Amendment") is made and <br />entered into effective the 8th day of April, 2022, by JEH Holdings, LLC, a Nebraska limited <br />liability company (the "Declarant"). <br />WITNESSETH: <br />WHEREAS, Declarant previously made and entered into an Amended and Restated <br />Declaration of Covenants, Conditions and Restrictions of the Villas at Stolley Park dated <br />December 20, 2019 (the "Covenants") which covered the real property located in the County of <br />Hall, Nebraska, and further described on Exhibit A attached hereto (the "Property"), and filed the <br />Covenants of record with the Hall County Register of Deeds on December 31, 2019 as <br />Instrument Number 201908192; <br />WHEREAS, Declarant, in accordance with the authority provided to Declarant pursuant <br />to Section 5.3 of the Covenants, desires to enter into this First Amendment. <br />herein. <br />NOW, THEREFORE, Declarant hereby desires to amend the Covenants as set forth <br />1. Article 1, Section 1.6 of the Covenants is hereby deleted in its entirety and replaced <br />with the following: <br />"Declarant Control Period" shall mean the period in which the Declarant controls <br />the Board of Directors and has approval rights under Article 3 below and shall expire <br />upon the first of the following to occur: (i) the date on which all Residential Lots have <br />been sold by Declarant to a new Owner, (ii) ten (10) years from the date of execution <br />of the Declaration, or (iii) after a minimum of fifteen (15) Residential Lots have been <br />sold by Declarant to a new Owner, the date on which the Declarant, in its sole and <br />absolute discretion, notifies the Association in writing that the Declarant Control <br />Period is terminated. <br />2. Article 2, Section 2.2(a) of the Covenants is hereby deleted in its entirety and <br />replaced with the following: <br />4857-6177-3593.3 <br />
