(D Z <br />W0,4 <br />o <br />WARRANTY DEED <br />with limited warranty of construction <br />The Orchard, LLC, a Nebraska Limited Liability Company, GRANTOR, in consideration of One <br />Dollar and 00/100 and other good and valuable consideration received from GRANTEE, Joyce <br />A. Lemburg-Taylor, conveys to GRANTEE, the following described real estate, (as defined in <br />Neb. Rev. Stat. 76-201): <br />Lot Five (5), Block Two (2), in The Orchard Subdivision, City of Grand Island, Hall <br />County, Nebraska <br />GRANTOR covenants jointly and severally with GRANTEES that GRANTOR <br />a. is lawfully seised of such real estate and that it is free from encumbrances, subject <br />to easements, reservations, covenants and restrictions of record; <br />b. has legal power and lawful authority to convey the same; and <br />c. warrants and will defend title to the real estate against the lawful claims of all <br />persons; and, <br />d. For one year from date Grantor warrants to Grantees that the residence on the <br />premises has been completed in a good and workmanlike manner substantially in <br />accordance with applicable building codes and zoning ordinances and in <br />accordance with the plans and specifications as modified by change orders under <br />a written limited warranty which is incorporated herein by this reference. This <br />Limited Warranty is the only express warranty provided by the builder, <br />Grantor. This warranty takes the place o <br />e.f all other warranties express or implied including any warranties of i) <br />merchantability, ii) fitness for a particular purpose, or iii) implied warranty <br />of habitability. Grantor is not under any circumstances responsible for and <br />Grantees waive all claims to INCIDENTAL AND/OR CONSEQUENTIAL <br />DAMAGES. The warranty provides procedures for claims against the warranty <br />which must be strictly followed.
