No application or petition for the appointment of a personal <br />representative is pending or has been granted in any jurisdiction. <br />7. Affiant, as claiming successor, is entitled to the real property by <br />reason of devise under the Will of the Decedent. <br />8. The claiming successor has made an investigation and has been <br />unable to determine any subsequent Will. <br />9. No other person has a right to the interest of the Decedent in the <br />described property. <br />10. The claiming successor's relationship to the Decedent is: Son. <br />11. That the interest of the decedent in the property was Subject to <br />Notice of Agreement for Sale and Purchase of Real Estate to Tracy A. Markham <br />recorded January 9, 2007 as Inst. No. 200700208; ALSO SUBJECT To Notice of <br />Agreement for Sale and Purchase of Real Estate to Kristi Massey recorded <br />January 31, 2008 as Inst. No. 200800761. <br />That aforesaid Tracy A. Markham defaulted almost immediately after <br />signing on her said Agreement and vacated the premises at that time and could <br />not be located. <br />That Kristi Massey thereafter entered into her above purchase agreement <br />and has satisfied all terms and conditions of the Agreement and been in <br />possession of the premises at all times. <br />
