WHEREAS, pursuant to that certain Deed of Trust, dated August 18 1999 from Grantor to Homeside <br />"Beneficiary" and recorded in ❑ Book , Page ; ® As <br />Instrument number 99108598 ❑ as Computer Reference number of the Public Records of Hall <br />County, Nebraska the Grantor executed and delivered a Deed of Trust to <br />Beneficiary on the following described real property (the "Real Property "): <br />Lot 37, in Jeffrey Oaks Third Subdivision in the city of Grand Island, Hall County, <br />Nebraska. <br />WHEREAS, the Deed of Trust in paragraph 1 provided for future advances to be made against the security of the Deed of Trust ; and <br />WHEREAS, the Borrower desires to obtain a loan from Lender in the amount of $ 10 , 163 . 00 , but the Lender is unwilling to <br />make such loan unless the Lender obtains a Deed of Trust on the Real Property and, further, that any future advances under the Deed of Trust are <br />limited and restricted as set forth herein; and <br />WHEREAS, Grantor desires to accordingly limit the maximum amount that may be secured under the Deed of Trust as a future advance. <br />NOW, THEREFORE, the Grantor does hereby state to and give notice to you as follows: <br />1. Notice is hereby given that the Deed of Trust shall secure an amount not to exceed the amount actually advanced and outstanding on the Deed <br />of Trust as of November 15, 2000 ­ The Grantor is of the opinion that such amount is approximately $ 110 , 000.00 <br />2.
