the lands covered by the Surface Leases being herein collectively called the "Facility Sites"), together with <br />all water, water rights, ditch rights and the permits and other evidence of authority or approval to appropriate <br />and/or use ground or surface water in connection with such land or the Facility Sites and all tanks, tank <br />batteries, injector stations, terminals, pumps, pipelines, plants, heaters, compressors, equipment and other <br />fixtures, personal/movable property, buildings and other improvements now or hereafter located on the <br />Facility Sites, and all building materials, building equipment and fixtures of every kind and nature located <br />on the Facility Sites, or attached to, contained in or used in any such buildings and other improvements, <br />and all appurtenances and additions thereto and betterments, substitutions and replacements thereof <br />(whether now owned or hereafter acquired by operation of any Requirement of Law or otherwise) located <br />on or under the Facility Sites (the "Facility Property") (the Facility Sites and the Facility Property are <br />herein sometimes collectively called the "Facilities"); <br />(b) All interests, estates or other claims, both in law and in equity, that Mortgagor now has or <br />may hereafter acquire in (i) the Facilities, (ii) all easements, rights-of-way and rights used in connection <br />therewith or as a means of access thereto, and (iii) all tenements, hereditaments and appurtenances in any <br />manner belonging, relating or appertaining thereto (Mortgagor's interest in all of the foregoing interests, <br />estates and other claims being hereinafter collectively called "Easements and Rights of Way"); <br />(c) All estate, right, title and interest of Mortgagor, now owned or hereafter acquired, in and <br />to any land lying within the right-of-way of any streets, open or proposed, adjoining the Facilities, and any <br />and all sidewalks, alleys and strips and gores of land adjacent to or used in connection therewith <br />(Mortgagor's interest in all of the foregoing estate, right, title and interest being hereinafter called <br />"Adjacent Rights"); <br />(d) The rights, interests and estates created under those certain servitudes, easements, rights of <br />way, privileges, franchises, prescriptions, licenses, leases, permits and/or other rights described in Exhibit <br />A, attached hereto and made a part hereof, and all of Mortgagor's right, title and interest (whether now <br />owned or hereafter acquired by operation of any Requirement of Law or otherwise) in any servitudes, <br />easements, rights of way, privileges, franchises, prescriptions, licenses, leases, permits and/or other rights <br />in and to any land, in any city, county, parish and sections shown on Exhibit A even though they may be <br />incorrectly described in or omitted from such Exhibit A together with any amendments, renewals, <br />extensions, supplements, modifications or other agreements related to the foregoing, and further together <br />with any other servitudes, easements, rights of way, privileges, prescriptions, franchises, licenses, permits <br />and/or other rights (whether presently existing or hereafter created and whether now owned or hereafter <br />acquired by operation of any Requirement of Law or otherwise) used, held for use in connection with, or <br />in any way related to the Facilities, and/or pipelines transporting hydrocarbons or other goods, including <br />crude oil, natural gas, natural gas liquids condensate, refined products or asphalt (collectively "Products") <br />to, from or between the Facilities (the rights, interests and estates described in this subsection (d) are herein <br />collectively called the "Servitudes"); <br />(e) Without limitation of the foregoing, all other right, title and interest of Mortgagor of <br />whatever kind or character (whether now owned or hereafter acquired by operation of any Requirement of <br />Law or otherwise) in and to (i) the Facilities, the Surface Leases, the Easements and Rights of Way, the <br />Adjacent Rights, and/or the Servitudes, and (ii) the lands described or referred to in Exhibit A hereto (or <br />described in any of the instruments described or referred to in Exhibit A); <br />(f) [Reserved]; <br />(g) All of Mortgagor's right, title and interest (whether now owned or hereafter acquired by <br />operation of any Requirement of Law or otherwise) in and to all improvements, fixtures, and other <br />real/immovable and/or personal/movable property (including, without limitation, all equipment, tanks, <br />8 <br />144646513 <br />;4.."
