<br />That certain Lease and Agreement for Business/Industrial Park Buildings/Ground Sites between
<br />SemMaterials, L.P. (as ultimate successor in interest to Consolidated Oil & Transportation
<br />Company, Inc.), as lessee, and Hall County Airport Authority, as lessor, dated February 1, 1999,
<br />as amended, covering the property described on the following page, which Lease was assigned to
<br />BKEP Materials, L.L.C. (f/k/a SemMaterials Energy Partners, L.L.C.) pursuant to that certain
<br />Assignment and Assumption of Lease Agreement effective as of February 20, 2008.

<br />Hall County Airport Authority dated July 11, 2007, as amended by that certain Fifth
<br />Amendment to Lease between SemMaterials, L.P. and Hall County Airport Authority
<br />dated August 8, 2007, as assigned to SemMaterials, L.P. pursuant to that certain Plan
<br />and Agreement of Merger between FGI, LLC and SemMaterials, L.P., dated December
<br />16, 2005, covering the property described on the following page, which Lease was
<br />assigned to SemMaterials Energy Partners, L.L.C. pursuant to that certain Assignment
<br />and Assumption of Lease Agreement effective as of February 20, 2008.
