202202347 <br />PARTNERSHIP JOINT TENANCY WARRANTY DEED <br />with limited warranty of construction <br />The Orchard, LLC, a Nebraska Limited Liability Company, GRANTOR, in consideration of One Dollar <br />and 00/100 and other good and valuable consideration received from GRANTEES, Vivian M.A. Turn <br />Hernandez and Denis Gomez De Leon, wife and husband, conveys to GRANTEES, as joint tenants with <br />right of survivorship and not as tenants in common, the following described real estate, (as defined in <br />Neb. Rev. Stat. 76-201): <br />Lot Two (2), Block Two (2), The Orchard Subdivision, City of Grand Island, Hall County, <br />Nebraska <br />GRANTOR covenants jointly and severally with GRANTEES that GRANTOR <br />a. is lawfully seised of such real estate and that it is free from encumbrances, subject to <br />easements, reservations, covenants and restrictions of record; <br />b. has legal power and lawful authority to convey the same; and <br />c. warrants and will defend title to the real estate against the lawful claims of all persons; <br />and, <br />d. For one year from date Grantor warrants to Grantees that the residence on the premises <br />has been completed in a good and workmanlike manner substantially in accordance with <br />applicable building codes and zoning ordinances and in accordance with the plans and <br />specifications as modified by change orders under a written limited warranty which is <br />incorporated herein by this reference. This Limited Warranty is the only express <br />warranty provided by the builder, Grantor. This warranty takes the place of all <br />other warranties express or implied including any warranties of i) merchantability, <br />ii) fitness for a particular purpose, or iii) implied warranty of habitability. Grantor <br />is not under any circumstances responsible for and Grantees waive all claims to <br />INCIDENTAL AND/OR CONSEQUENTIAL DAMAGES. The warranty provides <br />procedures for claims against the warranty which must be strictly followed.
