High Street <br />Cairo, Nebraska 68824 <br />nn <br />DEED OF TRUST <br />THIS DEED OF TRUST is made this /Ci day of January, 2022, by and among Jason <br />Rauert, a single person, with an address of 2511 East White Cloud Road, Grand Island, NE 68801, <br />and Dawn Rauert, a single person, with an address of 4209 W. Valhalla Blvd. #1, Sioux Falls, SD <br />57106, and Sharon K. Clark, a single person, with an address of 105 W. Oasis Street, #17, Cairo, <br />NE 68824, and Pamela C. Rieck and Larry Rieck, husband and wife, with an address of 615 South <br />Mary Drive, Tea, SD 57064, hereinafter collectively referred to as "Trustor"; and Denise Myers, <br />Attorney -at -Law, hereinafter referred to as "Trustee", whose mailing address is 415 S. High Street, <br />P.O. Box 505, Cairo, Nebraska 68824; and Pamela C. Rieck, 615 South Mary Drive, Tea, SD <br />57064, and Sharon K. Clark, 105 W. Oasis Street, #17, Cairo, NE 68824, hereinafter collectively <br />referred to as "Beneficiary". <br />For valuable consideration, Trustor irrevocably grants, transfers, conveys and assigns to <br />Trustee, in trust, with power of sale, for the benefit and security of Beneficiary, under and subject <br />to the terms and conditions of this Deed of Trust, the Trustor's interest in the following -described <br />property located in the County of Hall, State of Nebraska, to -wit: <br />The Southeast Quarter (SE1/4) of Section Twenty -Two (22), Township Twelve <br />(12) North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska, except <br />parcels listed in Document No. 99-102794. <br />together with all improvements, fixtures and appurtenances located thereon or in any way <br />pertaining thereto, and the rents, issues, profits, reversions and the remainders thereof, including <br />all such personal property that is attached to the improvements so as to constitute a fixture, all of <br />which, including replacements and additions thereto, are hereby declared to be a part of the real <br />estate conveyed in trust hereby, it being agreed that all of the foregoing shall be hereinafter <br />collectively referred to as the "Property". <br />This Deed of Trust shall secure (a) the payment of indebtedness evidenced by Promissory <br />notes of even date herewith in the principal sum of EIGHTY SEVEN THOUSAND FIVE <br />HUNDRED and NO/100 DOLLARS ($87,500.00) owed by Jason Rauert to Pamela Rieck; <br />EIGHTY SEVEN THOUSAND FIVE HUNDRED and NO/100 DOLLARS ($87,500.00) owed <br />by Jason Rauert to Sharon Clark; FORTY THREE THOUSAND SEVEN HUNDRED FIFTY and <br />NO/100 DOLLARS ($43,750.00) owed by Dawn Rauert to Pamela Rieck; and FORTY THREE <br />THOUSAND SEVEN HUNDRED FIFTY and NO/100 DOLLARS ($43,750.00) owed by Dawn <br />Rauert to Sharon Clark; which debts have a stated maturity date of January 21, 2029, and any and <br />all modifications, extensions, and renewals thereof or thereto, and any and all future advances and <br />re -advances to Trustor hereunder pursuant to the promissory notes; (b) the payment of other sums <br />advanced by Beneficiary to protect the security of the Notes; (d) the performance of all covenants <br />and agreements of Trustor set forth herein; and (e) all present and future indebtedness and <br />obligations of Trustor to Beneficiary, whether direct, indirect, absolute, or contingent and whether <br />arising by note, guaranty, overdraft, or otherwise. The Notes, this Deed of Trust, and any and all <br />other documents securing the Notes or otherwise executed in connection therewith, including <br />without limitation guarantees, security agreements, and assignments of leases and rents, shall be <br />referred to herein as the "Loan Instruments". <br />
