Boltz and Janet M. Boltz, husband and wife, as joint tenants with rights of survivorship and <br />not as tenants in common, an undivided one-half (1/2) interest, of Hamilton County, Nebraska, and Bryan L. <br />Stutzman and Colleen A. Stutzman, husband and wife, as joint tenants with rights of survivorship and not as <br />tenants in common, an undivided one-half (1/2) interest, of Hall County, Nebraska, all together the "Grantor", for and <br />in consideration of the sum of One Dollar ($1.00) and other good and valuable consideration, the receipt of which is <br />hereby acknowledged, do hereby grant, remise, convey and relinquish unto NorthWestern Corporation, a <br />Delaware corporation, d/b/a NorthWestern Energy, the "Grantee", of Huron, South Dakota, its successors or <br />assigns, a gas utility easement for the installation, maintenance and operation of an underground natural gas pipeline <br />along with all appurtenances thereto over, under, upon and through the following described lands situated in the <br />County of Hall, the State of Nebraska, to -wit: <br />A 10 -foot -wide tract of land consisting of part of the Southeast Quarter of the Southeast <br />Quarter (SE1/4 SE114) of Section Twenty-two (22), Township Eleven North (T11N), Range Ten <br />West (R10W) of the 6th Principal Meridian, Hall County, Nebraska, and more particularly <br />described as follows: <br />Commencing at the Southeast Quarter (SE1/4) corner of Section 22; thence on an assumed <br />bearing of South 88°38'04" West, along the South line of the Southeast Quarter of the <br />Southeast Quarter (SE114 SE114), a distance of 70.00 feet; thence North 00°12'59" East, a <br />distance of 33.00 feet to a point on the North county road right-of-way line of Stolley Park <br />Road, and also being the Point of Beginning (POB); thence South 88°38'04" West, along said <br />North right-of-way line, a distance of 10.00 feet; thence North 00°12'59" West, parallel with <br />the East line of the SE1/4, a distance of 1292.16 feet to a point on the North line of the SE114 <br />of the SE114; thence North 89°05'55" East, along said North line, a distance of 10.00 feet; <br />thence South 00°12'59" West, parallel with said East line, a distance of 1292.08 feet to the <br />POB; as illustrated in Exhibit "A" attached hereto.
