1 I •• I IN I I IIIII LAD v 0 ry F_a CD A Retum to: Robert Gehm NorthWestem Energy 0)) 3210 Douglas Avenue Yankton, SD 57078 GAS UTILITY EASEMENT KNOW ALL MEN BY THESE PRESENTS: ON 1N3WMISNI SV a1:131N] That Shirley Klinginsmith, a single person, the "Grantor", of Howard County, Nebraska, for and in consideration of the sum of One Dollar ($1.00) and other good and valuable consideration, the receipt of which is hereby acknowledged, does hereby grant, remise, convey and relinquish unto NorthWestern Corporation, a Delaware corporation, d/b/a NorthWestern Energy, the "Grantee", of Huron, South Dakota, its successors or assigns, a gas utility easement for the installation, maintenance and operation of an underground natural gas pipeline along with all appurtenances thereto over, under, upon and through the following described lands situated in the County of Hall, the State of Nebraska, to -wit: A 10 -foot -wide tract of land consisting of part of the East Half of the Northeast Quarter (E112 NE1/4) of Section Twenty-two (22), Township Eleven North (T11N), Range Ten West (R10W) of the 6th Principal Meridian, Hall County, Nebraska, and more particularly described as follows: Commencing at the Northeast (NE) corner of Section 22; thence on an assumed bearing of South 00°20'08" East, along the East line of the Northeast Quarter (NE1/4), a distance of 420.22 feet; thence South 89°39'52" West, a distance of 33.00 feet to a point on the West county road right-of-way line of Engleman Road, and also being the Point of Beginning; thence South 00°20'08" East, parallel with the East line of said NE114, a distance of 10.00 feet; thence South 89°39'52" West, a distance of 17.00 feet; thence South 00°28'08" East, parallel with the East line of said NE1/4, a distance of 2213.50 feet to a point on the South line of said NE1/4; thence South 89°33'46" West, along said South line, a distance 30.00 feet; thence North 00°20'08" East, parallel with said East line, a distance of 10.00 feet; thence North 89°33'46" East, a distance of 20.00 feet; thence North 00°20'08" West, parallel with said East line of the NE114, a distance of 2213.52 feet; thence North 89°39'52" East, a distance of 27.00 feet to the Point of Beginning; as illustrated in Exhibit "A" attached hereto. Said tract of land containing 0.519 acres, more or less. [The purpose of the above described easement is for an underground natural gas pipeline along with all appurtenances thereto (the "Facilities").]
